هل أحتاج إلى موافقة جهة عملي السابقة بعد الاستقالة للانتقال إلى وظيفة أخرى؟
س: لقد استقلت من وظيفتي أثناء فترة الاختبار وخدمت شركتي فترة الإشعار مدتها 15 يومًا بناءً على البند التالي: "يجوز إنهاء هذا العقد قبل انتهاء فترة الاختبار من الطرفين (إشعار مدته 14 يومًا تقويميًا على الأقل) وبدون سبب. إذا رغب الموظف في تقديم إشعار بإنهاء العقد أثناء فترة الاختبار من أجل الانضمام إلى موظف آخر في دولة الإمارات، يجب على الموظف أن يقدم لصاحب العمل إشعارًا كتابيًا مدته 30 يومًا تقويميًا على الأقل، ولا يحق للموظف الحصول على أي مكافأة نهاية الخدمة إذا تم إنهاء الخدمة أثناء فترة الاختبار. وافقت شركتي ووقعنا على تسوية مع عدم التزام أي من الطرفين بأي شيء للآخر وتم إلغاء تأشيرتي. لم أحصل على وظيفة حتى الآن، ولكني أردت أن أعرف أنه إذا قبلت وظيفة بعد ذلك، وخلال فترة السماح الخاصة بي، هل من الضروري أن أتصل بصاحب العمل السابق. نظرًا لأنني لا أرغب كثيرًا في إشراك صاحب العمل السابق في هذه التفاصيل.

س: أود أن أسأل فيما يتعلق بقانون العمل الإماراتي إذا كان على الموظف دفع أي تعويض للشركة بعد الاستقالة. لأن صاحب العمل يطلب مني أن أدفع هذا المبلغ. من فضلكم أريد الإجابات والمساعدة في أسرع وقت ممكن.

Can I resign during probationary period without paying compensation?
Q: Dear Sir/Madam, I am on a limited contract (I think, as it does not contain an end date but states a duration of 3 years). I am one month into a 6-month probationary period and I wish to resign. I am happy to serve the required notice period (14 days as stated in the contract), but I wish to understand if I will be liable to pay the employer compensation for resigning within the 3 years.

Employer asking to pay recruitment fees after 5 months of work: Is this legal?
Q: Hi! I have been working at a school in the UAE for 5 months now. I have submitted my resignation, and my employer is asking me to pay recruitment fees as part of my final settlement. Is this legal, even if I am serving my notice period? In my offer letter, my probation period is stated as one month, but in my contract, it is stated as six months. How do I file a complaint? س: سيدي/سيدتي العزيز/ة، تنتهي فترة الاختبار الخاصة بي، ومدتها ثلاثة أشهر، في 29 سبتمبر/أيلول. ينص عقدي على أنه يحق لصاحب العمل تمديد فترة الاختبار شهرًا واحدًا. هل يمكنني الاستقالة خلال شهر الاختبار المُمدد؟ أم سأضطر لدفع تكاليف التأشيرة؟ هل يمكنني استخدام شهر الاختبار المُمدد كفترة إشعار؟

What can I do If my employer is not providing me with the Emirates ID and health insurance?
Q: Good afternoon I've been working in a private company for about a year now, and my boss is not getting my ID because it has a fine, since he made the wrong procedure for my visa. When I am sick, it's too hard for me because I don't have an ID and I don't have insurance. And if I'm sick and can't go to work he is deducting from my salary 50 per day and the remaining salary is only 1500. Please it's really hard for me, I need your help.

What can I do about constant noise from my upstairs neighbors?
Hello, My neighbors on the upper floor are causing noise throughout the day, almost 24/7. They keep dragging furniture, dropping heavy objects, and slamming doors. The property manager was not very helpful, and I cannot sleep or take power naps. I sleep when they do and wake up when they wake up. Hello, My rent cheque was bounced, and my landlord filed a case against me in Sharjah Court. I received a fine of 2,000 AED, which was later reduced to 1,000 AED upon appeal. Does this case count as a criminal conviction under UAE law, or was it handled as a civil matter? If I apply for a U.S. visa, will I need to submit court records under the requirement for applicants with past convictions?

I received a termination letter from my company for restructuring. Is this considered arbitrary dismissal?
I received a termination letter from my company on January 31st, 2025, with a one-month notice period, stating my last working day as February 28th, 2025. The reason given for the termination is "considering the current business scenario, the company has considered measures to reorganize the business." Could this be considered arbitrary dismissal? Am I entitled to any compensation or benefits from the company as a result of this termination?

Do I need to hire a lawyer if I found I have a marital case against me in the court?
By checking in Al Adheed, I have found there is a marital matter case against me in Dubai Courts. There is a hearing date for next week and the time mentioned in the case status with a link for an online hearing. However, I have not received any message from Dubai courts regarding this by mail or phone. I have all contact details updated with EID. In this case, what should I do? I don’t know what the case is about. Should I hire a lawyer or I can attend the hearing by myself? Please do suggest options.

المساعدة في إنهاء قضية لدى الشرطة ورفع منع السفر في دولة الإمارات
طاب يومك، علي نزاعات إيجارية وحصلت على خطة تسوية منذ 8 أشهر. لكنني لم أدفع التسوية لأنه في لحظة التقدم بطلب للحصول على خطة التسوية، كان لدي عرض عمل وخسرته بسبب منع السفر ولم أتمكن من معالجة التأشيرة. علي قضية شخصية أخرى لدى الشرطة حيث قمت بالفعل بدفع مبلغ 18000 وكانت المطالبة 40000 درهم. والآن بعد أن لم التوقف عن الدفع، رفع المدعي القضية مرة أخرى. لدي الآن خطاب عرض آخر وأريد الحصول على شهادة مخالصة خلال 48 ساعة، وإلا فقد أفقد هذه الوظيفة أيضًا. برجاء تقديم النصيحة

كيف تعرف الحكم عندما تعرض الحالة في النظام "تم الحكم"؟
سيدي العزيز / سيدتي العزيزة، هناك قضية ضدي في محكمة تجارية ذات اختصاص كامل. آسف إذا كان هناك خطأ في هذا. لم أشارك في القضية، وبناءً على نصيحة محاميي في المملكة المتحدة، لم يتم تمثيلي هناك في دبي. عند التحقق من البوابة، تقول إنه تم التوصل إلى حكم بالأمس، لكن لا يمكنني رؤية المزيد من التفاصيل. لذلك أسئلتي هي: 1) هل تصدر الأحكام خلف أبواب مغلقة أم أمام المحامين؟ (المدعون لديهم محامون) 2) كم من الوقت يستغرق عادة حتى يصبح الحكم علنيًا ولكي أرى نتيجة القضية؟ الشيء الوحيد الذي يُقال على الإنترنت هو كلمة "تم الحكم".

الترحيل من الإمارات رغم سلامة نتيجة الفحوصات الطبية
مرحبًا، لقد تم ترحيلي من الإمارات بسبب عدم اللياقة الطبية، ولكن عندما وصلت إلى بلدي، أجريت عدة فحوصات طبية ولكن كل شيء على ما يرام؛ فيروس نقص المناعة البشرية سلبي، لا يوجد التهاب الكبد B، الخ. لا أعلم هل كان هناك خطأ أو سوء حظ بالنسبة لي. أتساءل عما إذا كان بإمكانهم السماح لي بالعودة إلى دبي.

Is it mandatory to visit the CID in person to update my records?
Respected Advisors, I have been involved in a few criminal cases since 2017, but all of them were cleared by this year. I have obtained release letters for all the cases from the public prosecution office through an online portal. Recently, I also received my residence visa. After the visa process was completed, I applied for a PCC online. However, the request was rejected. I contacted the 901 office, and they advised me to visit the CID. I arranged for a power of attorney to be granted along with all the necessary documents to update the system. Twice I was told to come in person, but I am hesitant to do so because of my previous negative experience. Could someone please advise me whether I must go in person or if the person holding the power of attorney can handle the process? Thank you!
