The public prosecution appealed a judgment to increase the fine I already paid. What do I do now?

Good afternoon,

Thank you for your time.

The public prosecution appealed my judgment (a fine that I satisfactorily cleared) and requested increasing the fine.

Can you please explain what happens during a criminal case appeal hearing for me as a defendant?

Will I be asked questions?

Is the hearing just for the Public Prosecution to present their appeal to the judge, and I do not need to give a response?

Thank you again for your time.

You may not be required to present your case verbally if you choose not to do so, it is common for defendants to provide responses during these hearings when appropriate.

The focus will primarily be on whether there were errors in how your case was handled initially.

Under UAE law, the public prosecution presents its appeal to the judge during a criminal case appeal hearing.

As the defendant, you may or may not be asked questions. In some cases, the hearing may focus solely on the Public Prosecution’s appeal, and you may not need to respond.

We specialize in such cases and can assist you in preparing for the appeal hearing. Contact us on WhatsApp for direct consultation.

Hi

Pursuant to your query you should attend the hearing and you should respond and submit your memo on the system before the hearing.

The appeal court will check the appeal that the public prosecution submitted because it depends on whether the judgment of the first instance court was right as per the law or whether there is a mistake with the fine.

The court will not ask you questions because you got a fine which you cleared.

Contact us by email and phone number.

During a criminal appeal hearing, the Public Prosecution will present their case, arguing why the fine should be increased.

You may not be asked questions directly, but if you have a lawyer, they’ll argue your side. The judge will decide whether to uphold, reduce, or increase the fine.

You don’t need to give a response unless asked, and the focus is on legal arguments rather than re-examining the facts of the case.

Greetings,

In the criminal case appeal hearing:

The Public Prosecution presents its reasons for appealing to request an increased fine.

The investigation is not reopened, nor are witnesses heard; rather, the judgment is discussed legally.

You are usually not required to speak unless the judge directs specific questions to you.

Your lawyer handles responding to the Prosecution and defending the original judgment.

The court may uphold the previous ruling, increase the fine, or reduce it.

Do you need assistance in preparing a legal response to the appeal?

We are happy at Future Vision Law Advocates and Legal Consultancy to assist you and provide the best legal services that meet your needs.
