استأجرت فيلا بعقد إيجار سنوي منذ 1 مارس 2021. في نوفمبر 2021، وبإشعار مدته 90 يومًا)، أبلغني المالك أنه سيزيد الإيجار بنسبة تزيد قليلاً عن 20%.
كان هذا أعلى من حاسبة الإيجار الخاصة بمؤسسة التنظيم العقاري، لكننا تحدثنا واتفقنا على نسبة 10%. في نوفمبر 2022، تلقيت بريدًا إلكترونيًا يفيد بأنه سيرفع الإيجار بنسبة 33%؛ أي ما يقرب من 50% في غضون عامين.
تحدثنا مرة أخرى ولكن لم نتوصل إلى اتفاق. لا تسمح حاسبة الإيجار الخاصة بمؤسسة التنظيم العقاري بأي زيادة. قيل لي أنه سيبيع العقار وتلقيت إشعارًا بالإخلاء بالتسليم المسجل (مدته 12 شهرًا) بتاريخ 25 نوفمبر 2022.
1. ينص القانون 33 لعام 2008 على أنه يجب تقديم إشعار مدته 12 شهرًا عند انتهاء عقد الإيجار. هل يجب تجديد العقد لمدة سنة أخرى من 1 مارس 2023 إلى 29 فبراير 2024؟

The landlord sent me a 90-day notice for a rent increase in his personal email.
The email address he used was not the one listed on the tenancy contract. Is this notice legally binding?
His rent increase exceeds the RERA index by a lot. If I refuse the increase, can he evict me?

لقد كنت أستأجر العقار الذي أعيش فيه منذ عام واحد الآن. تم تجديد العقد واتفقنا على زيادة قليلاً تتجاوز 5٪ المحددة في العقد.
قبل 3 أسابيع من التجديد، اتصل بي وكيل عقارات "لتنسيق تجديد العقد". اكتشفت لاحقًا أن هذا الوكيل عرض مستأجرًا آخر سيدفع حوالي 20 ألفًا إضافية لاستئجار العقار.
لكن لم يستطع مالك العقار إخلائي لأننا اتفقنا بالفعل على التجديد ويجب أن يعطيني إشعارًا لمدة عام واحد.
لقد جددنا العقد ووقعناه، وبعد أسبوعين، تلقيت إشعارًا بالإخلاء على بريدي الإلكتروني. عندما سألت مالك العقار عن ذلك، قال "أحتاج إلى إخلاء العقار حتى أتمكن من العيش فيه".
لديه حوالي 12 عقارًا يؤجره، وفجأة يريد العيش في هذا العقار المحدد حيث يعرض هذا "الوكيل" على المستأجرين إيجارًا أعلى.
هل من القانوني إصدار إشعار إخلاء حتى يتمكن من تحصيل إيجار أعلى؟

س: أقيم في منزل مستأجر في منطقة أبراج بحيرات جميرا، دبي. موعد تجديد عقد الإيجار الخاص بي اليوم هو 1 سبتمبر 2023. أرسل لي مالك العقار إشعارًا قبل 3 أشهر يطلب فيه زيادة الإيجار بنسبة 15%.
رددت عليه في نفس اليوم وأريته أن حاسبة الإيجار التابعة لهيئة التنظيم العقاري لم تظهر أي زيادة. وافق من خلال وكيله (شفهيًا) على إبقاء الإيجار كما كان في العام الماضي.
أرسل لي اليوم إشعارًا بأنه يريد مني السماح لأطراف ثالثة بمعاينة العقار لأنه يرغب في بيع العقار.
هل يمكنه إجباري على إخلاء المنزل أو السماح بهذه المعاينة؟
هل لا يجب عليه إخطاري قبل 12 شهرًا لأن تاريخ تجديد عقد الإيجار الخاص بي هو اليوم ولم يوقع عقد الإيجار الجديد معي بعد؟
ما هي الحقوق التي أتمتع بها إذا لم يبع العقار وأعطاه لشخص آخر بإيجار أعلى بعد إخلائي للمنزل؟

A new owner wants to increase the rent beyond RERA guidelines. What should I do?

Good Morning!
I live in Dubai and have rented an apartment since November 14, 2022, which I renewed on November 13, 2023, for a year at an amount of 41,800 AED (4 cheques).
Three to four months ago, the owner sold the apartment to a new person, and I had to change 2 payment cheques to the name of the new owner, one of which has already been encashed.
Now, as the renewal date (November 13) approaches, the new owner is asking for a rent increase of 5,000 AED.
I live in Dubai Silicon Oasis, and according to the RERA rental index, the maximum rent increase is 2,090 AED, which I informed the new owner. However, the new owner insists that, according to RERA, they can increase the rent by 5,000 AED.
I have researched extensively but found no information indicating that a new owner can increase the rent by this amount. Could you please clarify if the new owner can increase the rent by 5,000 AED?
How should I proceed if the new owner goes against RERA guidelines?

Can I block a new Ejari registration to prevent the landlord from re-renting the property?

Q: Dear Lawyers,
What are my rights in terms of eviction?
My landlord tried to increase my rent by 20% (per the RERA system, they were entitled to zero increase). We offered inflation as a response (all done via email).
After they accused us of being cheap and we reminded them that the system indicated no increase was applicable, they issued us an eviction notice for "family use."
We have since moved out, but now they are saying they will be selling the property and are providing us with a long list of maintenance items they want to withhold from the deposit (replacing water heaters, roof tiles, wheels on sliding doors), all of which were functioning properly during the nearly 3 years we lived in the house.
We suspect that now we are out, they will refuse to refund the deposit and will rent the house out again. I have heard you can block the registration of a new Ejari for rental.
What is the process for this, and do I have any other rights based on the above situation?

The owner of the property I’m renting has sent me an eviction notice so he can sell the property. According to the notice, I am required to leave. My questions are:
1. If the owner rents the property again, how can I obtain the new Ejari as proof that the property has been rented?
2. Do I have the right to ask for compensation? On what basis is compensation determined?
3. I currently have a signed tenancy contract with the owner. Do I need an Ejari to raise a case?

Dear Lawyers,
I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August.
Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F.
The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer's real estate commission and the conveyancing fee.
Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this?
Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?

Tenant always late with payments, hasn't renewed contract. What to do? 2
Hello,
I have a tenant who is always late with their payment. Their renewal was supposed to be last December 2023.
Currently, they have not signed any new contract, provided any new cheques, and have stayed for three months from December until now without paying rent.
Additionally, I just discovered that they have sublet the apartment with partitions, which is clearly stated as not allowed in the old contract.
Please let me know what should I do legally!

Tenant received renewal notice, rejected proposed rent on renewal day. What next? 2
Hi,
We sent a renewal notice to our Dubai-based tenant 84 days before his contract renewal, with a 10% increase in rent.
The tenant neither agreed nor disagreed with the proposed rent and replied on the day of renewal that he wouldn't be paying the proposed rent.
Due to the argument, the landlord decided to reduce the rent, but the tenant has not yet renewed his contract. It has been 12 days since his contract expired.
Kindly suggest what could be done in this matter.

Hi,
I am a non-Muslim indian expatriate, residing in Dubai since 2015. The first 5 years, I was on a working visa, and after the delivery of my first baby, I left my job and became dependent on my husband.
In 2018, we bought a house together where I invested AED 2 hundred thousand from my income (I have proof in the form of a cheque). I also paid AED 3300 monthly installment for 1 year, for a personal loan taken out for the house.
But in spite of my resistance, my husband tactfully put the house in his name, so the title deed was in his name. In 2024, when my kids and I were in India for vacation, he cancelled our visas and residency. He also filed for a divorce in India.
The divorce is not yet finalised, and we are still married. Since August 2024, he hasn't let me access my house in Dubai, so I filed a case, which eventually went in my favor in January 2025.
Since I used to travel on a visit visa, I left for India and returned in March, to find out that my husband had already sold the house. The new owner is residing there.
What can I do now?

I'm a nanny, and at the same time, I work as a housemaid (khadama) here in the house. I work, but as I know, the nannies and housemaids have different rights, and my employer doesn't give me rest.
My work starts at 7:30 am and then finishes at 10 pm or less. It depends on whether the baby is asleep or what time they will take on me if not yet asleep. Is this right?
Also, at the time of eating, I'm still working because the baby is with me, so I just let her sit in her chair. That's how I eat.
Please answer me. I want to know my rights.
Because if I can leave during the 6-month probation, I want to take it if the employer is this kind. I don't know.
They are also expats, but they don't follow the rules of the UAE regarding a housemaid.

My previous organization has not yet released EOSB because I contacted a client. Is this legal? 0

By checking in Al Adheed, I have found there is a marital matter case against me in Dubai Courts. There is a hearing date for next week and the time mentioned in the case status with a link for an online hearing.
However, I have not received any message from Dubai courts regarding this by mail or phone. I have all contact details updated with EID. In this case, what should I do?

Can the landlord send me an eviction notice for non-payment despite submitting an offer and deposit at RDC? 0
I’ve lived in my building for over 4 years, with the most recent rent being AED 50,000. Each year, the management collects cheques and extra AED 2,400–2,500 cash (no receipt) for management and Ejari fees.
My contract was due for renewal on 15 Feb 2025, but management delayed, demanding a 10% rent increase even though no formal 90-day notice and the RERA index did not allow it.
After a month of excuses, the manager called on 12 March, insisted increase to 55K, and threatened eviction if I refused. When I referenced RDC, he hung up. The next day, he again made unprofessional remarks, so I decided to go with RDC.
I submitted my offer and deposit on 13th March, but the management didn’t respond. The case went to the judge on 14 April he ruled in my favor.
On 30 April, I applied for the execution of the ruling, and RDC says I can renew Ejari only on 8th May at DLD with cheques given to them.
However, on 1st May 2025, I received a notarized eviction notice for non-payment of rent and communication.
My question is, what will happen at DLD now?

I am working in the private sector, and currently I am in the probation period. I got a government job, so I submitted a one-month resignation notice.
My current company rejected my one-month notice and ordered me to serve a three-month notice (as per the contract).
