How can I obtain the new Ejari as proof if the owner re-rents the property?

Good afternoon,

Ramadan Kareem!

The owner of the property I’m renting has sent me an eviction notice so he can sell the property. According to the notice, I am required to leave. My questions are:

1. If the owner rents the property again, how can I obtain the new Ejari as proof that the property has been rented?

2. Do I have the right to ask for compensation? On what basis is compensation determined?

3. I currently have a signed tenancy contract with the owner. Do I need an Ejari to raise a case?

Thank you!

Wish you a great day ahead.

Good afternoon,

Ramadan Kareem!

If your landlord has issued a vacating notice to sell the property but later rents it out instead, you may have legal grounds for compensation. Here’s what you need to know:

- Proof of New Tenancy (Ejari):

You can request a copy from the Dubai Land Department (DLD) or verify the new rental contract through the Ejari system. A legal expert can assist in obtaining this evidence.

- Right to Compensation:

If the landlord misused the eviction notice and re-rented the property, you may be entitled to compensation based on rental market rates and relocation costs.

- Filing a Case:

Your signed tenancy contract is valid for legal action, but having an Ejari registration strengthens your claim.

To assess your case and ensure the best legal course of action, book a consultation with us today. We can also represent you if legal action is needed.

Wishing you a great day ahead.

Dear Questioner,

Thank you for your inquiry, and Ramadan Kareem to you as well!

Regarding your questions:

1. Obtaining the New Ijari for the New Tenant:

You can request a copy of the new Ijari contract directly from the landlord or the real estate agent. The Ijari serves as proof that the property has been rented out again.

2. Right to Compensation:

You may be entitled to compensation if the landlord’s action to terminate your contract prematurely causes you financial loss or inconvenience. Compensation could include:

- Moving costs or the cost difference for renting another property.

- If the owner rents the property immediately after your departure, compensation will depend on the situation, including potential lost rental income or the inconvenience caused to you.

- Compensation is usually determined based on the damages you incur due to the early termination of the contract, including any higher costs associated with relocating.

3. Do You Need an Ijari to Raise a Case?

No, you do not need the new Ijari to raise a case. Your valid tenancy contract is sufficient to file a case if the landlord has wrongfully terminated the agreement or if you are claiming compensation.

If you wish to proceed with compensation claims or seek further advice, I can help you file a case with the Rent Dispute Center.

Please let me know if you require further clarification or assistance.

Best regards,

Mohammed Salah

Dear tenant,

The owner is not permitted to rent the apartment to another tenant. You can obtain a rental contract through the Real Estate Regulatory Agency.

You can request compensation based on the expenses you incurred while leaving the apartment and any other expenses.

The judge will decide on the compensation request at his discretion.

1. The new Ejari can be obtained by filing a petition order with the court.

2. Yes, you are entitled to compensation for illegal eviction. It will be based on the difference between your old rent and the rent you are paying for the new property, the damages and expenses incurred during the transition, and any additional profit made by the landlord from your eviction.

3. Yes, having the Ejari will be beneficial for the case. We will discuss the procedures in detail.

Kindly share your WhatsApp number for further discussion.

Hello,

Your tenancy contract is sufficient evidence of your rental agreement, and if you wish to challenge the vacation notice or claim compensation, you can present this contract as proof.

If the landlord re-rents the property after issuing an eviction notice, claiming they wanted to sell it, this could be deemed as misrepresentation or bad faith eviction.

If the eviction was issued under false pretenses (i.e., the landlord said they were selling the property but then rented it out), you may be entitled to compensation.

This could include: relocation costs, rental increases or damages, emotional distress, and inconvenience caused by having to vacate your home for reasons that were not as stated.

Dear Valued Client,

Ramadan Kareem!

Thank you for reaching out regarding your tenancy situation. I understand your concerns about the eviction notice you've received and the potential re-renting of the property. Please find below a professional assessment of your inquiries:

1. Obtaining New Ejari for Subsequent Tenants:

Unfortunately, as a former tenant, you do not have legal access to Ejari information for new occupants. Ejari registrations are confidential and accessible only to current tenants, landlords, and authorized authorities.

2. Compensation Rights:

If the landlord re-rents the property after evicting you for sale, you may indeed have grounds for compensation. The basis for compensation would be determined by the Rental Dispute Settlement Center (RDSC) based on factors such as:

- Duration of your tenancy.

- Emotional and financial distress caused by the eviction.

- Any relocation costs incurred.

- The difference between your rent and market rates, if applicable.

3. Ejari Requirement for Case Filing:

While an Ejari-registered contract strengthens your position, it is not an absolute requirement for raising a case. Your signed tenancy agreement is considered a legally binding document. However, Ejari registration is generally preferred for most rental-related processes in Dubai.

Recommended Actions:

a. Document all communications with your landlord regarding the eviction.

b. If you suspect the property is being re-rented rather than sold, gather any available evidence.

c. Consider filing a complaint with the Rental Dispute Settlement Center (RDSC) if you believe your rights have been violated.

d. Consult with a legal professional specializing in Dubai tenancy laws for personalized advice on your specific situation.

Please note that landlords must adhere to proper notice periods and legal procedures for eviction. If you believe these requirements have not been met, you may have additional grounds for dispute.

If you require any further clarification or assistance, please don't hesitate to contact us.

Best regards,

Have a pleasant day ahead,

To obtain the new Ejari for the new tenant, you can request it directly from the owner or the new tenant once the property is rented again.

Whether you're entitled to compensation depends on the terms of your tenancy agreement and local rental laws, typically based on early termination or inconvenience caused.

As long as you have a signed tenancy contract, you do not necessarily need the Ejari to raise a case, but it could strengthen your position.

Best Regards,

Good afternoon, and Ramadan Kareem to you as well!

Regarding your situation, if the landlord has served you a vacating notice for the purpose of selling the property but ends up renting it to a new tenant instead, you have legal grounds to challenge this under Dubai Rental Law.

- Obtaining the New Ejari:

You can request a copy of the new Ejari registration through the Dubai Land Department (DLD) or file a complaint with the Rental Dispute Center (RDC) to obtain proof that the property was rented again instead of being sold.

- Right to Compensation:

Yes, you may claim compensation if the landlord falsely used the sale as a reason for eviction but re-rented the unit. Compensation is generally calculated based on the rental market difference and any additional expenses you incurred due to the move.

- Tenancy Contract vs. Ejari:

While having Ejari registration strengthens your case, your signed tenancy contract is still a valid legal document. You can still file a case at RDC even if your Ejari registration is not available.

To take legal action and ensure you receive the compensation you deserve, I recommend discussing your case in detail.

Please reach out to me via WhatsApp or phone at [----------], and I will guide you on the best legal steps forward.

Best regards,
