Tenant received renewal notice, rejected proposed rent on renewal day. What next?

Hi,

We sent a renewal notice to our Dubai-based tenant 84 days before his contract renewal, with a 10% increase in rent.

The tenant neither agreed nor disagreed with the proposed rent and replied on the day of renewal that he wouldn't be paying the proposed rent.

Due to the argument, the landlord decided to reduce the rent, but the tenant has not yet renewed his contract. It has been 12 days since his contract expired.

Kindly suggest what could be done in this matter.

Dear questioner,

You can file a complaint in RDC and evict him if he is neither renewing the contract nor paying the rent.

You can claim in RDC for the increased rent if the tenant is moving for a renewal.

Dear Questioner,

If the landlord wishes to increase the rent, he has to notify the tenant of the same at least Ninety (90) days before the date of contract renewal.

If any dispute arises, you may refer to RDSC (Rental Dispute Settlement Center).

Dear Questioner,

According to UAE law, a landlord is required to give a tenant a minimum of 90 days' notice before increasing the rent.

In this case, it seems that the landlord has followed this requirement by sending the renewal notice 84 days before the contract expiry.

If the tenant has not agreed to the proposed rent increase and has not renewed the contract, the landlord can file a complaint in the RDC.

Moreover, since you have just given the 84-day notice, the contract can be renewed with the existing contract terms.
