Is overtime applicable on work-from-home days under company’s policy?
Hello,
The company has a policy allowing employees to work from home once per week.
Now, employees are asking if overtime is applicable for those who work from home as well.
Could you please clarify?
Thank you!
Greetings,
Overtime is applicable where you work more than 8 hours a day, exclusive of the one-hour rest during the day.
So if you worked more than these prescribed hours, then you are entitled to.
Best Regards,
Generally, overtime is applicable to employees regardless of their work location if they work beyond the legally stipulated or contractually agreed working hours.
The key factor is the number of hours worked, not the location where the work is performed. It can sometimes be more challenging to accurately track and prove overtime for employees working remotely.
Clear communication and established procedures for reporting and approving overtime are crucial. Employees working from home also have a responsibility to manage their time effectively and adhere to their agreed working hours.
Simply being "available" or checking emails outside of work hours might not automatically qualify as overtime unless specifically requested or approved by the employer.
If you need further clarification, we will discuss more. Kindly share your WhatsApp number to proceed.
Hello,
In the UAE, employees are entitled to overtime pay for additional hours worked beyond the standard working hours, regardless of whether the work is performed at the office or remotely.
Under the UAE Labour Law (Federal Decree-Law No. 33 of 2021), the standard working hours are 8 hours per day or 48 hours per week.
If an employee is required to work beyond these hours, the additional time is considered overtime and should be compensated accordingly.
