س: مرحبًا، باع مالك الشقة شقتنا وأرسل لنا المالك الجديد إشعار إخلاء. ينتهي عقدنا الحالي في 31.1.2024 وتلقينا إشعار الإخلاء في 17.7.2023. سؤالي هو ما إذا كان إشعار الإخلاء يجب أن يذكر التاريخ الذي نحتاج فيه إلى الخروج. من وجهة نظري، فإن إشعار الإخلاء لا يقل عن 12 شهرًا، لذا فقد يكون أطول. من الواضح أننا نريد عقدًا آخر، لذا فأنا أبحث عن طرق لتحقيق ذلك. بالإضافة إلى أنها وضعت السبب في أنها تريد استخدامه لنفسها أو أحد أفراد أسرتها من الدرجة الأولى. على أي حال، اشترت أيضًا شقة بجوارنا وأرسلت بريدًا إلكترونيًا إلى زوجي بأنها ستنتقل إلى هذه الشقة بجوارنا في يناير 2024، وتريد نقلنا حتى تتمكن جدتها من العيش بجوارها. قرأت أنها لا يجب أن تمتلك عقارًا آخر إذا أرادت استخدام هذا السبب لطردنا، خاصة إذا كانت تمتلك شقة أخرى وتستخدمها لنفسها. إذن كيف يعمل الأمر في الواقع؟ هل هناك أي طريقة يمكننا من خلالها القيام بشيء قانوني لجعلها تمنحنا عقدًا كاملاً آخر؟

Q: We were served a legal notice to evict our property as the landlord wanted to use the property for his personal use. This ended in 8 September. We shared an email 3 weeks before our eviction, stating that we did not want to move out and if we could stay, and we are only moving out to follow the law. The neighbors told us that agents have been hosting visits to the property. Today, the landlord has emailed me and said his circumstances have now changed and he has offered us the property back. I believe this is a tactic and he will be renting the property out soon. His reasons are due to circumstances that started for him in May, so our email 3 weeks before the eviction was more than enough time for him to raise this to us. In this case, should we decline to move back in (we have already moved and incurred huge costs and lifestyle changes to fit the new location), and the property is then rented out within 2 years, would we still be able to claim compensation?

Q: Dear Lawyers, I filed a case against my tenant after issuing a 12-month eviction notice. The lawyer I hired to handle the case did not pay attention to what I told him, causing me to lose the case. I informed him that the reason for the eviction was to move in, but he filed the case stating the reason was to sell. Since there were no supporting documents, I lost the case. الإخطار أو الإنذار القانوني هو إجراء قانوني يتم اتخاذه من قبل شخص أو منشأة أو كيان يدعى (المنذر- المخطر) بناء على نص قانوني أو اتفاق عقدي موجه إلى شخص آخر يدعى (المنذر إليه - المخطر اليه) لإبلاغه او إخطاره أو تحذيره باتخاذ إجراء قانوني معين أو تقديم شكوى قضائية ضده في حال لم يتم تنفيذ ما تضمنه الإنذار القانوني خلال المدة الزمنية المحددة به.

Provisions of this Law supersede articles (2), (3), (4), (9), (13), (14), (15), (25), (26), (29), and (36) of Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai. 

The provisions of this Law apply to real property leased out in the Emirate of Dubai, including vacant and agricultural lands, but excluding hotel establishments and real property provided by natural or legal persons as accommodation to their employees at no charge.

This Decree establishes a specialised judicial system to hear rent disputes and develops the procedure for determination of such disputes through an expeditious and simple process for the purpose of realising social and economic stability for all persons involved with the real property rental and other related sectors.
