The eviction notice is for personal use, the landlord wants to sell. Is it still valid?
Dear Sir/Madam,
I have received a notice through Dubai courts from the landlord stating that he does not want to renew for the purpose of "Personal Use," as mentioned in the notice.
He brought his family for viewing as well. After a couple of weeks of the notice, he sent me a WhatsApp message saying that he wants to show the house to other viewers because he is willing to sell.Is the notice I received still valid?
Should he send me a new notice mentioning that he wants to sell?
Does the current notice force me to leave the house in case he sells it before my contract ends?
Dear Client,
Thanks for your question! I hope you are doing well. I will assist you in this matter.
If your landlord initially gave you a notice for "personal use" but now intends to sell the property, they should provide a new notice specifically stating "sale" as the reason for termination.
Review your lease for details and consult with us to understand your rights and the validity of the notice. Typically, you can stay until your lease expires unless legally terminated.
For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.
We will be happy to help you.
Thanks & Regards,
ABDUL WAHIED

Hi,
The previous notice will not be valid if he is going to sell it.
Dear Questioner,
According to the Dubai Rent Law, your landlord has the right to terminate your tenancy for personal use by providing you with 12 months' written notice. He cannot rent the property out to someone else for 2 years after you vacate.
If your landlord's initial notice clearly stated "personal use" as the reason for termination, the notice remains valid even if he later decides to sell the property.
The 12-month notice period and the 2-year restriction on re-renting still apply. He does not need to send you a new notice mentioning his intention to sell.
However, if you suspect your landlord is using "personal use" as a pretext to sell the property and re-rent it faster, you can raise your concerns with the Dubai Rental Disputes Center (DRDC).
Dear Questioner,
I acknowledge receipt of your query concerning the notice from your landlord and the subsequent events that have transpired.
With a longstanding practice of 25 years dedicated to rental law, our firm is highly experienced in cases such as yours.
To address your concerns:
- Notice of Sale:
If the landlord intends to sell the property, he is required to serve you a separate notice regarding this intention. The original notice for "Personal Use" does not encompass his intention to sell, thus a new notice is essential for this purpose.
- Case Filing Post-Notice:
Following the 12-month period post-notice, should the landlord wish to proceed with the sale, he must file a case with the Rent Committee before any obligation for you to vacate can be established.
- Eviction Legality:
You are not compelled to vacate the premises unless there is an explicit decision issued by the Rent Committee. The landlord is obliged to substantiate his claim before the committee.
- Property Inspection Rights:
Regarding property inspections, the landlord does not possess an inherent right to bring family members for viewings. Your consent is required for such activities, and they are to be conducted sparingly and in accordance with the law.
Rest assured, we are fully prepared to defend your rights and ensure that all actions comply with the legal standards set forth by the Dubai rental laws. Should you require further representation or assistance, our doors remain open to you.
Please do not hesitate to reach out for any clarifications or to initiate further actions on your behalf.
Warm regards,
Abdellatif Al-Areed
I understand the importance of clarifying your rights and responsibilities in this situation.
Based on the information provided, it is crucial to differentiate between the landlord's rights under the "Personal Use" clause and the potential sale of the property.
In Dubai, landlords can terminate a lease for personal use, but there are specific procedures they must follow.
- Validity of the Notice:
The notice received from your landlord for "Personal Use" is likely valid if it adheres to the required legal procedures. However, any subsequent change in purpose, such as selling the property, may necessitate a new notice or clarification from the landlord.
- Notice for Sale:
If the landlord now intends to sell the property, a separate notice specifically stating the intention to sell should be provided. This notice should comply with the relevant legal requirements and should be distinct from the initial "Personal Use" notice.
- Impact on Your Tenancy:
The current notice for "Personal Use" does not automatically force you to leave in the case of a sale before your contract ends. However, the terms of your lease and local regulations will play a crucial role in determining your rights in such a scenario.
I recommend seeking legal advice specific to your situation to fully understand your rights and obligations. I am available to discuss this matter further and provide personalized guidance.
Please feel free to reach out to me via WhatsApp or phone to schedule a consultation.

Dear Questioner,
You are required to follow the reason mentioned in the eviction notice. If he sends you an eviction notice for the purpose of personal use, then he wishes to sell the property, he has to serve you another eviction notice.
Or you can deny the former eviction notice.
If you need further clarification, we will arrange a legal consultation session for a charge. Share your WhatsApp number if you want to go with the services.
Dear Customer,
To your knowledge, the landlord has three options for raising your rent or evicting you:
1. If he is a new landlord.
2. If you failed to pay one or two cheques.
3. If you have a fight with your neighbors supported by a police report.
If you do not have any of the issues listed above, we can certainly renew your contract through the courts with the same rent rate.
