اعتبار إنهاء خدمات الموظفة الحامل فصلاً تعسفيًا

س: السلام عليكم، أعمل محاسبة في شركة خاصة منذ تاريخ ٨/٢٠٢٠ ومشتركة بالضمان بدون عقد. دوامي يومي من السبت للأحد. الموضوع أني حامل بالشهر الرابع وكنت في إجازة مرضية للكشف على الجنين وأُبلغت بنفس اليوم أن المدير طلب إنهاء خدماتي خلال ٢١ يومًا من تاريخه. سؤالي: هل يُعتبَر إنهاء خدماتي طردًا تعسفيًا؟

س: السلام عليكم ورحمة الله وبركاته، تقدم لي رجل وتمت الموافقة عليه من جميع الأقارب ولكن القاضي يرفض الموافقة على الزواج لعدم حضور الوالد. الوالد مختفي منذ أكثر من أسبوعين ولم يتم التعرف على مكانه. تم تقديم بلاغ في مركز الشرطة عن غياب الوالد ولم يتم الرد حتى الآن. في هذه الحالة، ما الحل؟ مع العلم أني مخطوبة منذ شهرين وتم تأجيل كتب الكتاب بسبب وجود الوالد في مستشفى الطب النفسي للعلاج وكان الوالد موافقًا. بعد خروجه من المستشفى، تم تحديد موعد كتب الكتاب لكن قبل كتب الكتاب بأسبوع، تغيَّب الوالد ولم يتم التعرف على مكانه حتى الآن؛ مع العلم أني مطلقة وعمري ٢٩ عامًا. رفعت دعوى عضل الولي ولكن ليس لدي أي إثبات عن وضع والدي ولا أعرف ماذا أقول للقاضي وقت الجلسة خوفًا من الرفض!

Is it possible to issue an employment visa while a case is ongoing?

Q: My wife is having an ongoing case in Ajman since March 2020. The case is still under investigation till now. She is under my visa sponsorship and has recently applied for a job. The company hiring her wants me to cancel my wife’s husband`s visa to provide her with an employment visa from the company she applied for. Would the company be able to sponsor her? And if not, would I be able to renew her visa under my sponsorship as it will expire in two months? Thank you!

How to claim the share of a jointly owned property from husband after selling it?

Q: My husband and I jointly (50/50) own a property in Egypt. We agreed to sell the property. My husband said that money had to be first transferred to an Egyptian bank and as I do not have this, we agreed that funds would be transferred to him and then he would transfer them to UAE and give me my 50% share. Transfer labor dues of a deceased employee to his family in home country

Q: Hi, I am reaching out to seek advice on the payments (i.e. insurance claim, final settlement) as the employee passed away and left the spouse and two kids age 7-year-old son (autistic), and 1 & half year daughter. The employee is non-Muslim and passed away outside the UAE while visiting his home country. As an employer, we intend to pay the deceased family in their home country account for the insurance and final settlement. None of the deceased family members here in the UAE and the spouse will not be able to travel to the UAE in the given situation of the pandemic. However, the family is in great need of finances since they are the main beneficiary. As an employer, we seek advice if we can transfer the payment to the employee deceased beneficiary account in the home country instead of the deceased employee bank account in the UAE. Thank you

What can I do if the employer is not accepting resignation and visa cancellation?

Q: Sir, I`m working in a security company as a security guard since June 2018. Now my visa is going to expire in August 2021. I don`t need to renew my visa. I gave a resignation letter to the company but they are not accepting it. They are refusing it from head office.
