Q: Hi Team, I would like to ask. I'm an agent in the UAE, and my receivable commission has been delayed by my agency which is above AED 1 million. However the company is not running well lately, and it has a risk of insolvency. If it really happens, who should I claim my commission from? If there are still commissions not paid by the developer to the company, can I claim that part from the developer directly? Many thanks.

Q: I am writing to seek your legal expertise and advice on a pressing issue concerning a property sale transaction that my brokerage company has facilitated. Here are the details: Our brokerage company represented the seller in a property sale where the property was sold with an existing rental agreement in place. As per the terms of the agreement, the rental balance was supposed to be given to the buyer, who is now the new owner of the property. In this transaction, our company is entitled to a 40% commission, and the buyer's brokerage company is entitled to 60%. However, the buyer's brokerage company, which has complete control over the buyer's funds, has transferred the entire 100% commission to their own account. They are currently withholding this commission, stating that they will release it once the rental balance is paid to the buyer. Unfortunately, we have lost contact with the buyer, as he has blocked the seller's agent, making it impossible for us to fulfill this condition.

Q: My firm (based in Dubai) is owed AED 140,000 for providing manpower services to support catering operations for a Dubai-based business head office in Abu Dhabi. They have failed to pay my invoice since Sept 2017, we keep chasing them all but management changed and they don't bother to attend any emails or calls. What I'd like to do is recover my money with late fees and all legal fees. It's quite a long time now. They are a reputed group of companies and it seems they are not willing to pay. Please note that all documents are in place such as the agreement, invoices, and delivery notes. Any help or advice is appreciated, please.
