How can I clear an absconding case and claim my settlement after jail time?

Sir,

I was in jail for 2 months in a drugs case, and then my company filed an absconding case against me.

Now they are not removing the absconding case and are not ready to give me the settlement money.

What do I have to do?

The best course of action is to seek legal representation immediately, document all relevant interactions with your employer, negotiate for settlement payments through proper channels, and explore any available rehabilitation options that may support your case.

If you wish to be represented, please contact us via email or by phone.

Dear Inquirer,

If you were cleared or released in the drug case and your employer is refusing to remove the absconding report or pay your settlement, you have the right to take legal action.

You may file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE) or pursue the matter through the labour court.

To proceed effectively, we recommend booking a consultation with us or authorizing our office to represent you and protect your rights.

Your absence was due to your detention, which is a valid reason and should have been communicated to the company.

You are legally entitled to your end-of-service benefits and any other outstanding dues as per your employment contract and the UAE Labour Law, regardless of the absconding case.

You have to report this to MOHRE. In your complaint to MOHRE, clearly state that the absconding case is unjust, as your absence was due to legal detention, not abandonment of work.

Request MOHRE to investigate this and instruct your employer to remove the absconding report.

If you need further clarification, you may ask.

Dear Client,

You should immediately file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE) disputing the absconding report, especially since your absence was due to being in jail for a drug case; a valid and documented reason.

Provide all evidence, such as your jail records, to prove you were not absconding intentionally. MOHRE may arrange mediation between you and your employer, and if your reason is accepted, they can lift the absconding status and help you claim your settlement dues. If mediation fails, the case can be escalated to the labor court for a formal decision.

Do not delay, as an absconding status can lead to a work ban and other legal issues. Seek legal assistance if your employer refuses to cooperate.
