Q: My mother passed away last year and she had two daughters and a husband.
She didn't live in the UAE but owned a property in Sharjah. What documents do I require from my stepdad and sister? As both of them live in London.
I got a POA for them as I am a UAE resident. Could someone please advise me on how I can take over ownership of the property?

Q: Dear Ms. Rajasree,
I would like to seek your assistance in the processing of a succession certificate and the release of bank funds to the heirs of my deceased husband.
My husband died in Dubai on October 5, 2020. The bank has confirmed that death benefits on loan insurance have been credited and is on freeze due to legal and court documents needed.
I and my 3 children are currently in the Philippines.
Kindly advise on how can we process all the documents needed?

Can I put a financial guarantee to remove a travel ban in a rental case at RDC? 0
I used to work as a manager in a company, and my name was removed by the Dubai court of execution.
Now, on the paid rent, I got a travel ban, which I objected to at RDC.
The RDC accepted and gave the next hearing date, as I will have all the court papers.
Is there any way to remove the travel ban, as the objections I made at the execution hearing are next month, almost one month?
Is there any way you can put the amount as a deposit, and once the objection case is over, you can take it back?

Hi there,
My husband and I are Muslims. My husband passed away recently.
We have a Canadian will, but I understand that it won’t be honored as I am named the sole beneficiary, and that does not align with Sharia laws in the UAE. He was not a UAE resident but had a small apartment with no Will in the UAE.
We have 3 children. I am planning to go to Dubai to start an inheritance case. I don’t know the exact order of events and what needs to be done first.
1) Do I initiate anything from overseas before making travel plans to Dubai, or do I start once I arrive in Dubai?
Mind you, we cannot afford to stay in Dubai for too long, as the kids have school.
2) Do I need a lawyer, or can this be done by myself?
3) I understand all foreign documents need to be authenticated before presenting them to the court. But I don’t know at what stage I would need these documents authenticated.
I would appreciate it if you could provide a breakdown of the steps, the forms that are needed, and where I can find them.

A bank has filed an execution cheques case through the Dubai Courts due to nonpayment of a personal loan and credit card.
Is a travel ban automatically applied?
I looked on the Dubai Courts website, and it says the judge has issued a “reserved” order for my case.
Furthermore, when the bank emails, they threaten me with a travel ban. So I am assuming there is no travel ban issued (but I don’t know). I haven’t received any notice of a travel ban.
If there is a travel ban, how do I find out?
I have checked the Dubai police app, and there are no financial crimes against me.
Please advise if you know.

I purchased a freehold flat in Dubai and paid an initial 10% while signing the reservation agreement. However, due to financial issues, I am unable to proceed with the next payments.
My question is: Can the developer refund my funds? The 10% payment was made to the developer’s escrow account, but I haven’t signed the SPA yet.
I requested a refund from both the developer and the property agent, but they declined, stating that the money could not be refunded. Is there any way to recover my funds?

Dear Sir,
I bought a tenanted unit, and the tenancy contract was signed by one person. Shortly after, I found out that more people are living in the unit, and the tenancy contract doesn't allow subletting.
I contacted the phone number in the contract via WhatsApp, chatted with a woman, and highlighted the problem. She referred to the men living in my unit as "tenants."
At the end of our conversation, I learned that she is not my tenant. The tenant in my tenancy contract is a man, and I've received his Emirates ID from the previous owner.
He doesn't live in the unit, and the phone number and email address in the contract, given as his, are not his own. Is this legal? Is the contract still valid?
I would like to give my tenant an eviction notice because of subletting. I've found online that I have to give him a 30-day notice. Is that correct?
Is there any rental penalty for the breach of the contract? Can I get compensation for my legal costs?

I am buying a unit that is already rented out. The previous owner sent an eviction notice for sale to the tenant. I have some questions:
1. If the tenant is served an eviction notice of 12 months, do I still need to serve a notice after buying?
2. After the transaction, when the tenant leaves after 12 months, can I rent the apartment?
I don't need to wait 2 years in this case. Is that right?

I am a European resident and have owned an apartment in Dubai since November 8, 2023. The contract with the previous owner ended in September 2023, and the tenant was served an eviction notice until July 2024.
I find the tenant's behavior very problematic and am considering legal action. He has not paid any rent to me since I took ownership.
I invited him for a new 1-year contract without a rent increase, but he insists on forcefully signing the contract at the Dubai Land Department without my or my POA's signature and is compelling me to visit Dubai to collect the cheques.
Can you help with the following:
1) How can I get my rent?
2) Can the Dubai Land Department enforce the lease contract without my approval?
3) Given his behavior, I do not want to continue the lease agreement with him. How can I evict him as early as possible?

The eviction notice is for personal use, the landlord wants to sell. Is it still valid? 0

I have received a notice through Dubai courts from the landlord stating that he does not want to renew for the purpose of "Personal Use," as mentioned in the notice.
He brought his family for viewing as well. After a couple of weeks of the notice, he sent me a WhatsApp message saying that he wants to show the house to other viewers because he is willing to sell.Is the notice I received still valid?
Should he send me a new notice mentioning that he wants to sell?
Does the current notice force me to leave the house in case he sells it before my contract ends?
