Father passed away. What are the procedures to sell his property in the UAE?

Hi,

My family lives in Ireland and we are Irish citizens. We are not UAE residents nor do we have citizenship. I am the eldest son in my family.

My mother and father own property in Dubai, UAE. My father passed away last year. He did not have a will. I have his original death certificate.

My siblings and mother have granted me Power of Attorney to sell the property. I have notarized, authenticated, and legalized both these documents with the Irish Department of Foreign Affairs and the UAE embassy in Ireland.

The title deeds for the property are currently in my mother’s and father’s name. We have the keys to the property and the title deeds. I wish to sell the property as soon as possible to divide the proceeds with my family.

Would you be able to advise if I can fly over to Dubai to complete the sale of the property?

Would I need to transfer the names of the title deeds from my parents' names to my name first? What extra documentation would I need?

Thanks!

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

Yes, you can visit Dubai to complete the property sale, given that you have the necessary documents and PoA.

Transferring the title deeds to your name may simplify the process and could involve legal procedures in Dubai.

The extra documentation you may need includes the Succession Certificate due to your father's passing, a notarized and attested PoA, your father's death certificate, and any other property-related paperwork.

It's advisable to consult with us; we can guide you through the specific requirements and steps involved in your case.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

Dear Questioner,

We extend our deepest condolences for the loss of your father!

In response to your query regarding the sale of the property in Dubai, it is essential to have the proper legal documentation in order.

You will need to provide documents that confirm the passing of your father and legally establish that you and your siblings are the rightful heirs.

These documents must be officially authenticated and legalized to be recognized by the authorities in the UAE.

Furthermore, the Power of Attorney that your mother and siblings have granted you must also be in compliance with the requirements of the UAE.

I recommend that you have all the relevant documents reviewed by a legal professional specialized in UAE property law to ensure they meet all the necessary criteria.

Once your documents are in order, you should be able to travel to Dubai to proceed with the property sale.

Please contact us directly to discuss the specifics of the required documentation and any additional steps you may need to take.

Kind Regards,

Abdellatif Al-Areed

Dear Questioner,

Hope you are doing well!

As your father does not have any registered wills, we shall start the process through the court and request to apply your home country's law for the heirs.

Then, we can proceed with the transfer of the unit on behalf of all of you in the UAE.

If you have any other queries, you can reach us through email or via mobile.

I would appreciate it if you could leave your review and rate our advice if it helps you, thank you!

Best Regards,

MennaTullah
