Dear Client,

Thanks for your question!

I hope you are doing well. I will assist you in this matter.

In the UAE, end-of-service benefits (EOSB) should typically be paid within 14 days from the date of visa cancellation.

Since your visa was canceled on December 9th, your EOSB should ideally be processed by December 23rd.

Dear Questioner,

As per Labor Law article 53, the employer shall pay the worker within 14 days from the date of the contract termination all the financial entitlements.

So in your case, as the amount has not yet been received, you can file a complaint with MOHRE to get the amount.

Dear Questioner,

EOSB Payment Timeline: The UAE Labor Law requires employers to pay the End of Service Benefits within 14 days from the employee's last working day, not the date of visa cancellation.

Your Situation: Since your last working day was on November 30th, ideally, your EOSB should have been processed and paid by December 14th.

Visa Cancellation: Typically, the process of visa cancellation should commence after the settlement of all dues, including the EOSB. If the visa is canceled before the settlement of EOSB, this could potentially be a violation of labor laws.

Action if EOSB is Delayed: If you haven't received your EOSB within the stipulated 14 days after your last working day, you have the right to take further action.

This can include contacting your employer for clarification or filing a complaint with the UAE Ministry of Human Resources and Emiratisation (MOHRE) or the relevant local labor authority.

Documentation for Filing a Complaint: When filing a complaint, ensure you have all necessary documentation, including your employment contract, any correspondence regarding your termination, proof of your last working day, and any records of communication with your employer about the EOSB.

As always, if there are complexities or specific concerns about your case, it's advisable to consult with a legal expert familiar with UAE labor law to guide you through the process and ensure your rights are protected.
