Can landlords in Dubai increase rent if RERA index has not changed?

Hi,

I am an owner of an apartment in Dubai. It has been rented out for the past 2 years. The market rate of rent has now increased, however, the RERA index has not changed in the past 3 years.

I gave my tenant a 90-day notice notifying him of an increase in rent, however, he is not accepting and will only pay as per the RERA index.

The matter is now with the RDC, where he has filed a case against me. The RDC session is scheduled for next week. If I provide a DLD rent valuation certificate, will the RDC consider my request, or will they stick to the RERA index?

In case the tenant wins the verdict, will I have to pay any legal fees?

According to what you say, he will lose his lawsuit, and whoever loses the lawsuit pays the lawsuit fees.

The evaluation cannot be presented in the middle of the current issue.

What are the chances of me winning?

If they are not going to accept the DLD valuation as the case is already filed, will the RDC rule the verdict in favor of the tenant then?

You said he refuses to increase the rent according to the RERA index. This means that he is not right.

You can defiantly do something urgently to evict him and win the case before the next session.

Just ask your lawyer to do a counterclaim case.

In case the tenant won, you will pay the legal fees.

As for the evaluation, yes, go ahead and submit it in the court case that was filed. If the evaluation is higher than the RERA index, the judge will rule to increase the rent as per the new evaluation.

Hi R.,

As per the law, the RDC has to increase the rent in accordance with the RERA Index. If the tenant wins the case you might have to pay the court fees.

The RERA index has not changed in the past 3 years and rentals have increased significantly in the market.

This is a new building that is 3 years old, and the market rent for vacant apartments is almost 50% higher than the RERA index.

If I provide a DLD rental valuation certificate, will this help at the RDC?

As per the law, the rental increase has to be in accordance with RERA Index. If you still want to, check please with the RDC and ask them.
