Q: If salary is given delayed by the employers for 3 months and the employee filed for resignation, is the employer capable of giving a ban to the employee?
And is it legal to deduct 45 days from the settlement because the contract was not finished?

I have serious question regarding the salary delay issues. Well, can the employer hold salary for more than 3 months?
Because now its already the 4th month running and we as staff are yet to receive the salaries. So, please advise us what we can do in this matter as we are all now in no man's land.

Passport confiscation by police for a claim by the employer

Q: My company has filed a Breach of Contract case against me 6 months back. For the same reason, my passport was held at the police station.
The company filed this case as retribution to the case I filed against them, hence it is a weak case and they are not pushing forward with it.
There is no update on the case status from the police and it has been more than 6 months since my passport is held.
What is the timeframe for cases to proceed?
Can the police hold my passport indefinitely?

Salary reduction without the employee's consent and false counterclaim on labour case

Q: Hello.
My husband is a heavy truck driver in a transport company in Dubai, working in that company for the last 4 years. His boss (arbab) suddenly asked them to work on less salary of just AED 2500.
My husband and his other 3-4 colleagues were not willing, so their boss started harassing them. He didn't pay their money, made them sit free at home for many months, neither was he canceling them.
So they took legal help and filed a case against him in the labor court. In turn, that boss filed a criminal case against my husband and his colleagues, a false case that they have made a loss to his company by stealing and selling diesel illegally.
He has got a confession letter signed by them by lying. he told them as papers for attending safety classes. He didn't allow them to see the papers. The papers were in English which they don't understand being not much educated.
He has put a loss claim of approx.1 lakh dhs on each of the 4 persons. What are our chances in this situation?

Labor rights of an employee when the employer refuses to hand passport

Q: Hi Sir
I was canceled by my employer but he refused to hand over my passport. He doesn't want me to change my status and I don't know the reason.
He canceled the visa without my knowledge and he sent me the cancellation paper on the 10th day of my grace period for which he knew I only have 28 days.
I asked him to give me my passport because I have to renew it before I can apply for a new visa or change my status, it states that a passport should be more than 6 months before a UAE visa can be issued.
He, later on, put on absconding that I ran away but it's false.
I also lost my wallet phrase which I wrote and hid inside the cover case of my passport and about $37,000 worth of crypto has gone missing because I can't find the trust wallet phrase to recover my crypto.
They want to give me the passport but that cover case is missing, can I file a case for compensation for putting false absconding and unlawful holding of my passport and know the whereabouts of the passport cover case?

Q: Hi,
My query is that my husband and his 3 colleagues won a criminal case that was filed against them by their employer accusing them of theft and cheating. The employer has not paid full salary and gratuity and has harassed them a lot for 18 months.
My husband and his colleagues want to claim everything by filing a case in labor court. Are there any chances that the employer can file any other case in civil court against them?
The Dubai court has already dropped all the criminal charges that were put by him on my husband.
Can they move forward with filing the other case in labor court?
Is there any risk from the employer?

Employer filed absconding case for resigning over unpaid salary: Is it legal?

Q: Hey,
My employer filed an absconding case against me on September 4, 2023, during my notice period, which ended on September 7, 2023.
However, I stopped going to work on August 11, 2023, because I had not received my salary for July, while the rest of the team had been paid.
I sent an email to HR explaining that I could not get to work due to transportation problems, and they replied asking me to send all handovers by email and promised to send my final settlement, which I received two days ago.
My last day of work is listed as August 11, 2023, and the reason for leaving the company is listed as RESIGNED, both of which are correct.
Is it legal to file an absconding case against an employee who resigned and stopped going to work because the employer has not paid their salary?
I have not yet been paid for July.

My company filed a criminal case against me after I filed a labor case for holding my salary. What to do?

I need urgent help in Dubai.
I filed a labor complaint about my unpaid salary, but after that, my company filed a criminal case against me based on a chat I had with my colleagues about salary and company issues.
Now, I am on a visit visa with a travel ban, and my financial situation is very bad. I don’t know how to resolve this legally or get a new visa.
Can anyone guide me on what to do?

لدي استفسار بخصوص رفع دعوى ندب خبير مصرفي لدراسة البطاقات الائتمانية في حال كان هناك تسوية لتحويل الرصيد المحمل بالفوائد المتراكمة إلى أقساط شهرية.
ففي هذه الحالة لا يقوم البنك بتزويد الخبير كشوفات الحساب من تاريخ إصدار البطاقة، ويكتفي بتزويد الخبير الكشوفات من بداية الخطة مما يرتب علي عدم تصفية الحسابات بشكل حسابي دقيق.
ماهي الاجراءات المتبعة لإلزام البنك بتزويد كافة الكشوفات منذ إصدار البطاقة لأن أصل الدين كان محملاً بالفوائد المتراكمة وثم تم تحميل الرصيد مرة أخرى بفوائد على أصل الدين والفوائد المتراكمة؟
حيث أن هناك خلط كبير بتعريف خطة الدفع بالتقسيط محملة بفوائد جديدة وبين تسوية بين البنك والعميل لتخفيف مبلغ أصل الدين بنسبة معينة ودفع المبلغ على ٦ أو ١٢ شهراً دون زيادة فوائد جديدة.

Cancellation of visa from old employer to work for a new employer 0
My employer is not cancelling me. They terminated me last November and accused me of stealing which was not proven.
Now, I have a new offer letter, though the salary is lesser. I informed them so they can cancel me already and she agreed as per her message.
But now it’s been two weeks and she’s not replying to me anymore. I’m on a limited contract and finished 6 months probation with their company.
Will there still be a labour ban?
If she files an absconding case against me, what should I do?

المطالبة باسترداد الأقساط المدفوعة للمطور بسبب التأخر في تسليم العقار 0
السلام عليكم
أنا مواطن خليجي اشتريت شقة قيد الإنشاء في دبي، مشروع royal estates تحديداً. المبلغ الاجمالي ٣٣٠،٠٠٠ درهم.
دفعت قرابة ٥٦٪ من قيمة العقار حتى الآن، واكتشفت قبل عدة أيام أن المشروع متوقف عن العمل.
*طريقة الدفع المتفق عليها في العقد كانت كالتالي:
١- دفع ١٠٪ من قيمة العقار مقدماً.
٢- دفعات شهرية لمدة ٣ سنوات (٣٦ دفعة).
٣- دفع ٢٠٪ من قيمة العقار عند الاستلام.
٤- دفعات شهرية لمدة سنة ونصف (١٨ دفعة).
حتى الان دفعت ١٠٪ مقدم و ٣٦ دفعة بالكامل، ما يعادل ٥٦٪ من قيمة العقار تقريباً. على أساس أن الدفعة المطلوبة القادمة ستكون عند التسليم.
علماً بأن التسليم كان متوقعاً بعد شهرين من الآن، لكن لم يبنى المشروع بعد. والآن تقول الشركة أن التسليم في ديسمبر ٢٠١٨. علماً بأن المشروع في دائرة الأراضي والأملاك متوقف، under cancellation decision
١- فما هي نصيحتكم لي؟
٢-هل يمكن المطالبة عن المبالغ السابقة بالإضافة إلى تعويض وأتعاب المحاماة؟ وكم ممكن يكون التعويض؟

Calculation of the End of Service Gratuity upon termination 0
I am looking for advice on how to best proceed with receiving the amount of gratuity promised in my contract. I have worked for my employer for 4 years on an unlimited contract.
One month before my visa renewal, the employer informed me that they will not renew my visa and will end the working relationship. My contract states that my basic salary is AED 13,000, with no subdivisions.
Now, the employer claims that this was a mistake and they meant to write AED 6,000 as basic salary and allocate the rest for travel, living etc. They are only willing to pay the gratuity based on this amount.
Please advise, what is the amount the employer owes me as gratuity and how to proceed?

Liability of a restaurant for injury caused to customer 0
Hi.
We had an incident at a restaurant's outdoor event for families.
At their food stalls, there was nowhere any signs that the stalls are hot on the front customer-facing side or even covered.
Kids were running around and accidentally our daughter touched one panel and got a severe 2nd-degree burn. This happened on Friday and we have been to hospital each day to change the dressing and cut off skin.
I wonder if there is any legal action I can take against the restaurant, and what might the outcome be?
