Questions & Answers
My company filed a criminal case against me after I filed a labor case for holding my salary. What to do?
Hi everyone
I need urgent help in Dubai.
I filed a labor complaint about my unpaid salary, but after that, my company filed a criminal case against me based on a chat I had with my colleagues about salary and company issues.
Now, I am on a visit visa with a travel ban, and my financial situation is very bad. I don’t know how to resolve this legally or get a new visa.
Can anyone guide me on what to do?
Any legal advice or solutions would be really helpful.
Please help
Dear S.,
Your situation requires immediate legal action to resolve the travel ban and criminal case. Here are the key steps to take:
1. Check the Status of the Criminal Case: You need to verify the details of the case filed against you. This can be done through Dubai Police or the Public Prosecution.
2. Travel Ban Inquiry: You should confirm the exact reason for the travel ban. We can assist in checking this for you.
3. Defending Against the Criminal Case: If your company has filed a case based on chat messages, we need to examine the evidence and determine the best defense strategy.
Freedom of speech and labor rights are protected under UAE laws, and we can assess whether their claim holds legal grounds.
4. Unpaid Salary Claim: If your employer owes you money, you still have the right to pursue your labor case despite the criminal complaint.
5. Visa Options: Since you are on a visit visa, resolving the legal issue is necessary before obtaining a new employment visa.
We recommend you contact us immediately to review your case documents and take the necessary legal steps to resolve the travel ban and defend against the charges.
Hello,
If the criminal case was filed against you based on conversations you had with colleagues (e.g., about salary issues or company matters), your employer might be accusing you of defamation or damaging the company’s reputation.
Freedom of expression and the ability to discuss workplace issues are generally protected, especially if there’s no intent to harm the reputation of the company.
It is illegal for your employer to retaliate against you for filing a complaint regarding unpaid wages, including by filing criminal charges based on your internal conversations.
You have legal protection under the UAE Labour Law against such retaliation. If the employer files a criminal case after your complaint, you may be able to argue that the charges are in retaliation for exercising your labor rights.
According to UAE law, you can appeal the criminal case if it's based on personal conversations, and you can challenge the travel ban in court.
Regarding a new visa, you may need to resolve the case first. You can contact us via WhatsApp for further legal assistance, as we specialize in such cases and have experience in handling them.
