Q: Hello,
I am currently employed as a subcontractor to work on a project in Dubai.
As a general practice, I have provided a security cheque against the advance payment, and the client is now threatening to deposit the cheque even after completing more than 50% of the works due to various delays on site.
Is this legal? What steps can I take to protect myself?

Filing a case when the handover of an apartment is not expected to be on time

Q: Hello,
I purchased an off-plan apartment in Aug 2017 from a developer in Dubai. The payment plan is 50% prior to handover, 50% on handover.
The property has been registered with Oqood, 30% have been paid to date as per installment schedule. The anticipated handover date was supposed to be October 2019. The developer extended the handover date till October 2020 as per the 12-month buffer they have under contract.
They have claimed that the delay is due to their subcontractor going bust, so they have had to kick them out and replace them with a new one. As of Jan 2020, work has not started again on the project.
My questions are:
1- Given the progress rate to date (30%), it is unlikely that they will be able to complete it on time. Can I take them to court now for an expected breach of contract?
2- Can they claim that their initial subcontractor going bust is a Force Majeure?
Noting that they have never officially communicated this information to their customers (this was only mentioned verbally during a call).

What can I do with the contractor I paid to build my house and disappeared before completion?

Q: Hey,
I'm building my house in Dubai, and it was going well.
I gave the contractor 420k as a first payment, and we both agreed that the rest would be in installments. Just two months ago, the contractor went off the grid, and I can't find him.
All I have is a security cheque that bounced back when I went to the bank, as the signature doesn't match what's in the file.
However, I learnt that he does have money, but not the amount that's in the cheque.
What should I do now to get my money back?
I need advice.

Last week, I settled my debt under the Amicable Settlement Center in Dubai Courts. The plaintiff acknowledged the receipt of the total payment from me.
However, it was also stipulated in the amicable settlement that the plaintiff needed to make sure the travel ban against me had to be cancelled immediately.
However, now one week later, he still hasn’t lifted the travel ban and isn’t responding to my call/message.
As I need to travel, I would like to know:

My brother's brother-in-law was arrested at Fujairah Airport, as he was carrying 25 bottles (each of 10 Grams) of new shama kamini vidrawan ras.
This is an ayurvedic formulation that promotes sexual wellness. The ingredients help to enhance libido in men.
As he (brother's brother-in-law) informed police that my brother asked him to carry this ayurvedic medicine, as he (my brother) wanted to gift it to his few friends, as this is cheaper in India.
As of now, both my brother and his brother-in-law are arrested by police stating that this medicine contains drugs and is kept in Fujairah Central Jail.
It's been more than 15 days since my brother's brother-in-law (arrested on 26th June), and more than one week since my brother's arrest (6th July).
Now, I don't have any idea or information about what will happen and what the current status is.
Your kind advice and help will be highly appreciated.

Can I cancel the deal if an advertised 2-bedroom apartment is officially a 1-bedroom? 0
Hello,
I'm in the process of buying an apartment. The apartment was listed as a 2-bed, and when I asked to see the floor plan, it was marked as a 1-bed.
I was told by the agent that this was a mistake/mislabel and that the seller is trying to get it fixed. In the process of obtaining the NOC from the developer, the apartment was again listed as a 1-bed, and when I asked for it to be updated, the developer mentioned that the apartment is officially registered as a 1-bed.
Since it was spacious, it was offered as an internal modification, but the official classification is 1-bed and that can't be changed. I checked with the DLD, and the apartment is registered as a 1-bed as well.
I was not aware of any modifications and was not told any of this by the agent when signing Form F.
Are the above facts grounds for me to back out of the deal, or does the classification not matter in this case?

I recently reverted to Islam, and my marriage was solemnized in a civil court in the Philippines. There is no divorce law in the Philippines, and even if there were, it would take a significant amount of time and money.
Could you please advise if I can file for divorce in the UAE through the Family Court or Sharia Court?
What are the chances that my divorce will be granted? If the divorce is approved, am I permitted to remarry in the Sharia Court?

I have Form F for an apartment in [----], which caught a huge fire recently.
There is no force majeure clause in the contract, but according to the law in the UAE, it shall be terminated without penalty.
The seller doesn’t want to cancel the contract F, and the broker of seller is not refunding the deposit.

I have a rental dispute judgment against me to vacate, but the landlord is not fullfilling his obligations. What to do? 0

I have a real estate rental dispute.
1) My rental dues have been wrongly quoted, and the same has to be corrected with the court and then paid off. I had taken it up with the landlord, but the Landlord's legal department and property manager are just not responding
2) I had been given a decision from the court to clear my items and hand over the custody of the flat, but the Landlord did not adhere to the court order, due to which the eviction happened.
3) The Landlord had paid some amount to the Court for the Items and now had reached out for payment to allow me to take the items.
I have paid the amount to his account directly, but he has now appointed an auction house to auction the items.
I have to take immediate action to stop the same and allow me to obtain the items or claim compensation.

I have received a final judgment in my favor for 5 months' salary, and I’ve already initiated execution through Al Adheed Center.
Now, my employer is requesting to settle the matter outside the court and promises to pay the full amount within 45 days. However, due to past false promises and non-payment, I am hesitant to trust him.
Could you please advise:
1. Is it safer to continue with the execution process?
2. If I choose to accept the settlement, how can I legally document the payment schedule to ensure enforcement if he defaults?
3. Can this settlement agreement be filed or endorsed through Al Adheed or the court to keep legal pressure?

What can our company do if the client cancelled the order and threatened to file a case for the cancellation fee? 0
Salaam Alekum
We had a client from the US who had an agreement with us for 19-20 big buses for 20 days of transport service in KSA. They cancelled 12 buses and then the entire order 2-3 days before the event.
They paid around 25% of the total cost initially agreed on 50% before the event.
We have been keeping those buses on hold for more than 1 month, not taking other bookings, and facing losses.
My company is charging them 50% cancellation fees because of last-minute cancellation, but now the client is threatening us to take legal action and doing PR advisement by asking for the deposit they paid.
Our policy is refund will be issued within 45 days after internal investigation, but the client is threatening us again.
We don't give a refund if the cancellation is done by the client and mentioned on the invoice as well. In this case, we are considering a solution which takes time.
What can we do in this situation, as we have already faced lots of loss?

The agent promised me cashback, but he’s left the company and they won’t pay. What can I do? 0

An agent from a company in the housing space promised me a percentage cashback from the brokerage if I booked the house through him.
He sent this understanding via both his company and personal email. After regular follow-ups, he paid a certain percentage but claims the company is not willing to release the remaining amount.
The agent has since left the organization and started his own business, and I am left hanging to deal with the company on my own. I have never visited or had any contact within the company.
Please help or guide me in the right direction, as the amount is my hard-earned lifetime savings and is considerably large.

I left the UAE with an unpaid loan and the bank presented my security cheque. Is this legally accepted? 0
Dear Sir,
Warm greetings.
In 2019, I obtained a loan of AED 260,000 from a bank and have since repaid approximately AED 96,000. Due to the COVID-19 pandemic, I lost my job and was unable to continue payments.
The bank later bounced a security cheque for AED 260,000. I subsequently paid AED 10,000 as Qafala to the court. In 2022. A cheque execution case was filed against me by the bank through Abu Dhabi Public Prosecution, and a travel ban was imposed.
I also filed an ASHKAL request in 2023, but have received no response from the court. Please note that the case is registered in Abu Dhabi.
I kindly seek your guidance on the following:
1. Is it possible to close/remove or cancel the case on the basis that the cheque was a security cheque?
2. What is the process to request removal of the travel ban, as my job requires travel to other GCC countries?

Hello,
I am purchasing an apartment in Dubai from a seller who originally bought this flat at an auction. There were outstanding service charges from the building management company prior to the auction.
That pending amount was never updated on the Mollak system as a write-off, and until now, it appears as outstanding on the statement of account.
When I buy this apartment, an NOC is being issued stating that there are no dues from the owner, and based on that, I intend to finalize the deal. I would like to know if, in the future, I may be asked to clear these pending service charges by the owners' association.
The building management company is trying to clear the outstanding amount with Mollak, but it seems it’s taking a lot of time. What should I do?

Can I cancel my house sale contract without extra fees after personal plans changed? 2
Dear Lawyers,
I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August.
Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F.
The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer's real estate commission and the conveyancing fee.
Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this?
Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?

Tenant always late with payments, hasn't renewed contract. What to do? 2
Hello,
I have a tenant who is always late with their payment. Their renewal was supposed to be last December 2023.
Currently, they have not signed any new contract, provided any new cheques, and have stayed for three months from December until now without paying rent.
Additionally, I just discovered that they have sublet the apartment with partitions, which is clearly stated as not allowed in the old contract.
Please let me know what should I do legally!
