Questions & Answers
I have a rental dispute judgment against me to vacate, but the landlord is not fullfilling his obligations. What to do?
Hi
I have a real estate rental dispute.
1) My rental dues have been wrongly quoted, and the same has to be corrected with the court and then paid off. I had taken it up with the landlord, but the Landlord's legal department and property manager are just not responding
2) I had been given a decision from the court to clear my items and hand over the custody of the flat, but the Landlord did not adhere to the court order, due to which the eviction happened.
3) The Landlord had paid some amount to the Court for the Items and now had reached out for payment to allow me to take the items.
I have paid the amount to his account directly, but he has now appointed an auction house to auction the items.
I have to take immediate action to stop the same and allow me to obtain the items or claim compensation.
Dear Client,
Regarding your real estate rental dispute, here is what you can do:
1. Correction of Rental Dues in Court:
You should formally file an application or motion with the court to correct the wrongly quoted rental dues.
Since the landlord and their legal department are unresponsive, the court can update the official amount payable after reviewing your evidence.
2. Enforcement of Court Decision for Clearance and Handover:
If you have a court decision allowing you to clear your items and hand over the flat, the landlord is legally obligated to comply.
You can file a complaint with the Rental Dispute Center or the enforcement authority for the landlord’s non-adherence.
3. Stopping Auction of Items & Claiming Compensation:
Since you paid the landlord directly for the amount they deposited with the court, the landlord no longer has the right to auction your belongings.
You should immediately file a motion or complaint with the court or Rental Dispute Settlement Centre to stop the auction and seek compensation for any unlawful actions.
I can assist by:
- Drafting and filing formal applications with the court and authorities
- Communicating with the landlord’s legal team to enforce court orders
- Advising on compensation claims and legal actions to protect your rights
Please let me know if you would like my assistance to act swiftly on your behalf.
Kind regards,
Abdul Wahied

Hi,
Thank you for reaching out regarding your tenancy dispute.
Based on the information you've shared, it is crucial to immediately file an enforcement request with the UAE Rental Dispute Center (RDC) to address the incorrect rent calculation.
Also, to enforce the court’s previous order regarding the handover of the property, and prevent the unlawful auction of your belongings—especially since you've already settled the agreed payment.
In parallel, you may also request a precautionary attachment order to freeze the auction and secure your rights.
If the landlord continues to act against the court's directive, you are entitled to pursue a compensation claim for damages.
To proceed effectively, I recommend arranging a consultation so we can review the court documents, payment receipts, and correspondence in detail and advise you on the appropriate legal actions, including filing and follow-up with the RDC.
Please let me know your availability to schedule a session.
Best regards,
Hello,
You must take immediate action. First, gather all documentation, including the initial court decision, proof of your payment, and any communication from the landlord or the auction house.
Then, you need to file an urgent execution case with the court that issued the original decision.
You can request a judge to issue a "precautionary attachment" order to immediately stop the auction and compel the landlord to return your items.
Simultaneously, you should report the landlord's non-compliance with the court order to the Rental Disputes Center (RDC) in Dubai.
You have a strong case for claiming compensation, as the landlord's actions have caused you damages and breached a legal judgment.
For further assistance, kindly share your WhatsApp number.
This appears to involve multiple breaches by the landlord, including non-compliance with a court order and wrongful handling of your possessions, which may entitle you to urgent relief to stop the auction and claim compensation.
Do you have copies of the court decision, payment proof, and any correspondence with the landlord or property manager?

Thank you for contacting us via Legal Advice Middle East.
From your description, there are several legal angles that require urgent handling. First, to correct the rental dues in the court records, you will need to submit a formal petition or objection with supporting documents, as the court will not amend figures based solely on verbal claims.
Second, since there is already a court decision ordering the landlord to allow removal of your belongings, their failure to comply constitutes a violation of a judicial order, which can be enforced through an urgent execution request.
Third, given that you have already paid the amount requested for your items, appointing an auction house without releasing them may be considered unlawful disposal of property.
In a similar case our office managed, we obtained a stop order against an auction within 24 hours and recovered the client’s possessions.
We can assist you with filing the urgent request, documenting the payment proof, and pursuing compensation for damages.
