Q: I bought a home in September 2022. The previous owner has given an eviction notice to the tenant in July 2022. The eviction notice mentions the date of 31st July 2023 for eviction. After I bought it, I did not give any fresh notice to the tenant. There was a verbal agreement that the tenant will leave the place by 31st July 2023. Now the tenant is mentioning that he believes a fresh notice needs to be given with another 12 months' notice. I want to understand the below: 1) Do I need to give fresh notice of 12 months to my tenant? 2) Is the eviction notice sent by the previous owner still valid?

The property was sold to a new owner prior to the end of the 12-month period. The tenant claimed that the previous eviction notice was invalidated due to a change of ownership and refused to vacate. The new landlord sent a subsequent court-stamped notice, referencing the date of the previous eviction notice and instructing the tenant to leave as the landlord desires to move in himself. The tenant claims that the subsequent notice has no legal basis, neither in reinforcing the original notice nor as a new 12-month eviction notice. The original 12-month eviction period will expire on June 8 and the new landlord will raise an RDC case on June 9 to evict the tenant.

Q: Good Afternoon, We rent around 50 apartments for hotel staff accommodation in Dubai. This building has been sold to another person. The new owner is asking us to evacuate the building as soon as possible because he is selling these apartments. We have had the same accommodation since last year. Now, he is using a point mentioned in the contract: "3. This flat is for (Family Use Only), otherwise, the landlord has all rights to vacate the tenant from the property instantly and the tenant loses his/her rights and all the benefits under this lease, and the tenant agrees to this term. Pets not allowed." My question is: Does he have the right to force us to leave, and what is the grace period allowed for us to evacuate the apartments? Our current contract expires in January 2025. The provisions of this Law apply to real property leased out in the Emirate of Dubai, including vacant and agricultural lands, but excluding hotel establishments and real property provided by natural or legal persons as accommodation to their employees at no charge.

Provisions of this Law supersede articles (2), (3), (4), (9), (13), (14), (15), (25), (26), (29), and (36) of Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai.
