س: مرحبًا،
لديّ نزاع مع المالك. لقد استأجرنا فيلا في إمارة دبي لمدة عام واحد وقبل شهر واحد فقط من انتهاء عقد الإيجار الخاص بنا، طلب منا المالك الإخلاء وأبلغنا أنه لا يريد تجديد العقد لأنه يبيع الفيلا.
لدينا بند في العقد ينص على أنه:
يجب على المستأجر ومالك العقار إرسال إشعار كتابي مسبق مدته 60 يومًا قبل انتهاء عقد الإيجار لإلغاء عقد الإيجار أو تجديده.
لم نُعرب عن رغبتنا في التجديد قبل 60 يومًا من انتهاء العقد ولكننا فعلنا ذلك بعد أن طلب منا الإخلاء.
حاولت كثيرًا إقناع المالك بالتجديد لأنه يحتاج إلى إرسال إشعار إخلاء مدته 12 شهرًا في حالة بيع العقار وأيضًا لم يرسل إشعار لعدم تجديد الإيجار قبل 60 يومًا.
من فضلك أريد معرفة حقوقي، وفي حال لجأت إلى لجنة فض المنازعات الإيجارية، هل سأربح القضية؟

Q: Hi,
An eviction notice was registered through a notary public, but the courier didn't deliver it because the tenant wasn't home, didn't pick up the phone, and the paper was not stamped on the door, hence, the tenant never knew of it.
Is the eviction notice valid?

أود أيضًا معرفة ما إذا كنت بحاجة إلى الاعتراض عليه (وهي مسألة مكلفة) أو ما إذا كان بإمكاني تجاهله (وانتظر حتى يبدأ المالك في رفع قضية نزاع أو إرسال إشعار جديد).
التفاصيل: تدعي شركة إدارة الإيجارات أن مالك العقار قد أرسل إشعارًا رسميًا بالإخلاء من خلال كاتب العدل منذ أربعة أشهر. ومع ذلك، لم أتلق هذا الإشعار مطلقًا.
أرسلت لي شركة إدارة الإيجارات صورة للإشعار بالإخلاء وقسيمة تسليم أرامكس من خلال تطبيق الواتس آب.

What to do if the landlord sent me a rent increase notice to an unregistered mail?

Q: Dear Lawyers,
I filed an offer & deposit but due to the nonresponse of the landlord, the case was rejected as confirmed by RDC.
1. Offer & deposit filed at the beginning of Jan 2025, supported by the Dec 2024 RERA Rental Index, which indicated no rent increase for my lease expiring in Jan 2025. However, the landlord mentioned that the updated RERA Calculator for this year reflects a 5% rent increase.
2. The landlord claims to have sent a rental notice over 90 days prior, but the email was sent to an unregistered address. As per the tenancy contract, the email address they used is not the official one.
RDC advised me to wait for the landlord to file a case against me, as I am not in urgent need of Ejari. However, I am concerned about potential legal repercussions for non-payment of rent & would like guidance on the following:
• Do I have a compelling case based on the details above?
• How & where can I deposit the cheques to avoid the landlord suing me for non-payment?

I recently purchased a rented apartment in Abu Dhabi and agreed to honor the existing lease. After the transfer, I discovered that the lease is not a Tawtheeq contract, meaning it is not officially registered.
Since I am not receiving rent (as it was a non-refundable arrangement with the seller), I prefer not to issue a new Tawtheeq. I also want to avoid a formal notice to vacate to prevent disputes, as I plan to move in.

What can I do if my tenant is not providing rent cheques nor responding to renew the tenancy contract? 0
Hi,
I am a landlord and need advice on the following scenario.
- The contract with my tenant expired in Sep 2024. Upon requesting the renewal, the tenant mentioned that she is out of the country and will sign the renewal contract and provide the rent checks. In the meantime, she paid the first quarter of rent through a bank transfer.
- After 3 months, when the next quarter's payment was due, she deposited the next quarter's rent into my bank but did not sign the contract renewal despite my follow-up with her multiple times. At this time, she had returned to Dubai.
- Now the next quarter payment is due, however, the tenant is not responding to WhatsApp or answering calls. She is NOT paying rent or renewing the contract.
What action can I take since she is not answering my calls or messages?
She does not have a valid contract or Ejari, and her rent is delayed by 1 month. All WhatsApp messages are delivered, but she chooses not to respond.

Can the owner of a company escape if there is a cheque execution and travel ban on him? 0
I raised a cheque execution case against a company and its owner and won. There is a travel ban on him. I was receiving installments for three months and now he stopped paying.
The court after request summoned him. In total, he paid only 30% of the owed money. I found that his company license is expired and also in the month his visa will expire.
Does he have any option to avoid payment?
Please note he was deceived by showing no money in his bank account and no assets in his name but he is running multiple businesses.
Also a month ago, he tried to convince me to lift the travel ban but I refused to do so. But he submitted a guarantee and left UAE.
Now the status shows he is back in the UAE and the travel ban imposed again. But after that, he stopped payment.
Is there a 1% chance of him not paying me the remaining money?
Is there a way he can leave the country through the Amnesty program or any of this sort?

Hello,
I purchased a one-bedroom off-plan unit in Dubai from a well-known developer under an SPA specifying an area of 801 sq. ft. I completed all payments as per the developer’s payment plan, and the unit was handed over to me without a Title Deed.
After taking possession, furnishing the unit, signing a tenancy contract, and making repeated follow-ups to obtain my Title Deed, the developer informed me, 45 days after handover, that the actual area was 1,041.41 sq. ft., a 30% increase from the original SPA terms.
To receive my Title Deed, they are now demanding payment for the increased size.
Key issues:
- Failure to notify me before handover about the 30% increase in area.
- The SPA allows for price adjustments for area variations but specifies that such adjustments must be reflected in the final installment, which I had already fully paid before handover.
- The developer has now filed a legal case through Dubai Courts, demanding payment.
I require legal advice based on RERA/DLD laws and the SPA.
