طلب المالك من المستأجر إخلاء فيلا لبيعها

س: مرحبًا، لديّ نزاع مع المالك. لقد استأجرنا فيلا في إمارة دبي لمدة عام واحد وقبل شهر واحد فقط من انتهاء عقد الإيجار الخاص بنا، طلب منا المالك الإخلاء وأبلغنا أنه لا يريد تجديد العقد لأنه يبيع الفيلا. لدينا بند في العقد ينص على أنه: يجب على المستأجر ومالك العقار إرسال إشعار كتابي مسبق مدته 60 يومًا قبل انتهاء عقد الإيجار لإلغاء عقد الإيجار أو تجديده. لم نُعرب عن رغبتنا في التجديد قبل 60 يومًا من انتهاء العقد ولكننا فعلنا ذلك بعد أن طلب منا الإخلاء. حاولت كثيرًا إقناع المالك بالتجديد لأنه يحتاج إلى إرسال إشعار إخلاء مدته 12 شهرًا في حالة بيع العقار وأيضًا لم يرسل إشعار لعدم تجديد الإيجار قبل 60 يومًا. من فضلك أريد معرفة حقوقي، وفي حال لجأت إلى لجنة فض المنازعات الإيجارية، هل سأربح القضية؟ أشكرك شكرًا جزيلاً.

What to do if the landlord sent me a rent increase notice to an unregistered mail?

Q: Dear Lawyers, I filed an offer & deposit but due to the nonresponse of the landlord, the case was rejected as confirmed by RDC. 1. Offer & deposit filed at the beginning of Jan 2025, supported by the Dec 2024 RERA Rental Index, which indicated no rent increase for my lease expiring in Jan 2025. However, the landlord mentioned that the updated RERA Calculator for this year reflects a 5% rent increase. 2. The landlord claims to have sent a rental notice over 90 days prior, but the email was sent to an unregistered address. As per the tenancy contract, the email address they used is not the official one. RDC advised me to wait for the landlord to file a case against me, as I am not in urgent need of Ejari. However, I am concerned about potential legal repercussions for non-payment of rent & would like guidance on the following: • Do I have a compelling case based on the details above? • How & where can I deposit the cheques to avoid the landlord suing me for non-payment? The employee initiated discussions regarding a salary increment approximately 30 days prior, during which the management engaged in meetings with the employee but ultimately decided to maintain the current salary. I updated my review and mentioned that I appreciated the gesture. But he called again, threatening that his business partner might file a case against me. I purchased a tour voucher from a holiday agency in Dubai in 2023 worth AED 4239.00, but was not able to use it due to a visa problem. I have constant email and communication through phone with them, and they informed me back then that my voucher will be available and has no expiration date that I can use anytime I want.
