How can I avoid salary account seizure if Dubai Courts have ordered my assets to be frozen?
Hello,
Dubai Courts have sent a circular to freeze my assets in a cheque execution case dating back to 2023.
An installment plan was in place, but I missed payments.
The outstanding amount is AED 26,000. How can I avoid seizure of my salary bank account?

You can contact the court and acknowledge that you have a previous installment plan and are unable to pay it.
You can then negotiate a new installment plan. There are several options available to you, such as requesting a stay of execution or transferring the amount owed to another party, or you can authorize us to take these actions and resolve the issue.

According to Article 242(9) of Federal Decree-Law No. (42) of 2022 on Civil Procedures, salaries and wages are protected from full attachment. The law states:
Salaries and wages held by the employer, even if transferred to a bank account, shall not be attached except up to one-quarter of the total fixed salary or wage. In case of multiple claims, priority shall be given to alimony debts.
Therefore, even if an execution order is issued in a cheque case, your salary account cannot be entirely frozen.
The bank or enforcement authority must limit the attachment to 25% of your salary, and you have the legal right to file a request with the Execution Judge to lift or adjust the attachment if it exceeds this limit.
