س: عزيزي المحامي،
أنا مستأجر في دبي، وأطلب المشورة بشأن الوضع التالي:
ينتهي عقد الإيجار الحالي وهو عقد لمدة عام واحد في 22/09/2022 (خلال 78 يومًا). كمستأجر، أريد تجديد عقد الإيجار والمالك يعلم بذلك.
يرغب المالك في بيع الشقة، ومع ذلك، فالأمر غير مؤكد لأنه لم يتم العثور على مشتري.
لم يتم إرسال أي إشعار رسمي بالإخلاء على الإطلاق، فقط رسائل واتساب يدعوني فيها إلى الانتظار حتى يتمكن المزيد من المشترين المحتملين من القدوم لرؤية الشقة.
لأسباب واضحة، أنا لست على استعداد للانتظار حتى اللحظة الأخيرة لمعرفة ما إذا كان من الممكن تجديد عقد الإيجار - والوكيل العقاري (المعين من قبل المالك) يضغط لجلب المزيد من المشترين المحتملين.
بالنظر إلى النقاط المذكورة أعلاه:
1- هل يمكنني "إجبار" المالك على تمديد عقد الإيجار الآن؟
2- إذا قام المالك ببيع الملكية قبل تاريخ الانتهاء، فهل سأضطر إلى الخروج في تاريخ الانتهاء (دون أي إشعار)؟

س: مرحبًا،
انتقلنا للتو إلى الشقة (منذ ما يزيد قليلًا عن شهر) والآن يقول المالك أنه قام بإدراج العقار للبيع والإيجار منذ ثمانية أشهر، ولم يتم إخبارنا بهذا لا من الوكيل أو المالك.
وبالنظر إلى أنه كان لدينا خططًا للبقاء لفترة طويلة، فقد أنفقنا مبلغًا كبيرًا على الأثاث والديكورات الداخلية. أتلقى الآن مكالمات لمعاينة الشقة، لذا رجاءً أن تساعدني في فهم:
1) هل يمكنني أمنع دخول المالك للمعاينة؟
2) هل يمكنني الانسحاب من العقد والمطالبة بجميع مصاريفي بعد خصم الأيام التي بقيت فيها بالشقة، بما في ذلك رسوم الوكيل؟

What are the rights of a tenant if the landlord does not renew the lease contract?

Q: Dear Sir/Madam,
I have been renting a 1-bedroom apartment for the past 3 years. The owner appointed an agency last year to manage the property, as I had previously dealt directly with the owner.
I told the agent that I would be sending an email which is to be forwarded to the owner, stating my intent to renew the contract.
The agent then informed me that he had sent me an email informing me that the owner does not wish to renew the contract, as he is considering selling the apartment.
When I asked the agent for the email, he said he had sent it to me a couple of weeks ago. I was surprised to find that the email was from the agent's personal email address, and it read as follows:
Dear Madam,
We would like to inform you that as per the landlord, he doesn't want to renew your lease contract. He decided to sell the property. This is formal notice to the tenant as a non-renewable contract.
Regards,
I would like to stay on for another year, so please can you inform me of my rights as a tenant?

What happens to the rent increase and eviction notice upon selling the property to a new owner?

Q: I am a tenant in a villa. The landlord wants to sell the property to a new owner who wants to move in.
My rental agreement is till August 15, which means my 90-day increase notice is due on May 15.
Three parts to this question:
1. If the current owner serves me a 12-month notice, can the new owners still increase my rent?
2. If the current owner doesn't accept my counter-offer for the rental increase that he served before the notice (My offer is in line with the RERA calculations, but his is not), can he legally increase my rent if I get an eviction notice?
3. Is my eviction notice still valid if the sale of the property goes through? Or must the new owner serve me a new notice?

Q: Can a tenant refuse to leave my house although he has agreed and signed a clause in the tenancy contract?
The contract stipulates that if the owner finds a buyer for his property, the tenant will leave within 90 days of being informed and he will get an AED 31000 compensation.

Dear Lawyers,
I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August.
Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F.
The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer's real estate commission and the conveyancing fee.
Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this?
Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?

Tenant always late with payments, hasn't renewed contract. What to do? 2
Hello,
I have a tenant who is always late with their payment. Their renewal was supposed to be last December 2023.
Currently, they have not signed any new contract, provided any new cheques, and have stayed for three months from December until now without paying rent.
Additionally, I just discovered that they have sublet the apartment with partitions, which is clearly stated as not allowed in the old contract.
Please let me know what should I do legally!

Tenant received renewal notice, rejected proposed rent on renewal day. What next? 2
Hi,
We sent a renewal notice to our Dubai-based tenant 84 days before his contract renewal, with a 10% increase in rent.
The tenant neither agreed nor disagreed with the proposed rent and replied on the day of renewal that he wouldn't be paying the proposed rent.
Due to the argument, the landlord decided to reduce the rent, but the tenant has not yet renewed his contract. It has been 12 days since his contract expired.
Kindly suggest what could be done in this matter.

What to do if our landlord keeps ignoring maintenance requests despite a clear contract? 0
Dear All,
We have a question related to private rental law in Dubai. We have been living in the same house (rented) for the last four years.
During those years, we have had to battle our landlord for maintenance at large. Our contract states that ALL maintenance is on his account (no deductible).
We have a lot of small maintenance issues, such as kitchen cabinets that are coming loose, a sewage smell in the house, and a toilet upstairs that still doesn't work after four years (despite attempted maintenance).
How can we deal with him and get him to honor the contract and resolve all of our issues so we can use the house properly? What legal steps can we take?
We have informed him plenty of times over the four years about the problems, but he seems to "ghost" us and does not reply very often.
We have issued him a warning to get things fixed by the end of this month (via WhatsApp), but he doesn't seem to mind.
Hope you can help with advice and maybe RERA down the line.
