Calculation of the annual leave salary upon termination
Q: Please help me with the below scenario. I had worked with a company for three years. I was terminated on the basis of redundancy on 15th Jan 2019. They gave me one month notice period which ended on 15th Feb 2019. I completed the notice period and now joined another company. At the end of my notice period, I have 34 leave days as balance. In my final settlement, the company is paying me these 34 days on the basis of BASIC salary only. My argument to them is that I should be paid as per article 79 of the UAE labour law which states that my leave days shall be paid on the basis of wage. I want your help to understand if I am eligible to receive a full salary (basic + allowances) for my 34 leave days or it is only BASIC SALARY for 34 days.

Labour case by the employee after the payment of entitlements
Q: One of our staff was on an Unlimited Contract. We gave him a 30 days` notice stating that we won`t be renewing his contract. We paid him in cash his EOSB - 21 days for each year + Leave Salary (not basic, but full salary) + Ticket Money in Cash. He signed and it`s mentioned in the company letter all full and final settlement received with no outstanding. Now, this employee has filed a complaint at the Labor Department and denied receiving any cash. I have raised this complaint to Dubai Courts. What are our chances of winning? Deportation and possibility to return back to the UAE
Q: Hi, I am an Indian and living in Dubai for the last 25 years. My son had a criminal case on document forgery and he served three months jail term then got deported from the UAE. I am not very sure if he has been blacklisted and got a lifetime ban. The judgement states "3 months jail and deportation". Recently I checked at Sharjah Immigration and found no ban on him. However, I`m a bit scared that he will be blocked and arrested at the airport on arrival on a tourist visa. Defaulting on the payment of a loan EMI and legal consequences
Q: Dear Mr Hari, Good day. I took a loan from a bank one year back for AED 64,000 and now I have an outstanding amount of AED 48,500 which I am now unable to pay due to the loss of employment. I have also missed 1 EMI until now and have not paid this EMI for the past 3 months, however, I somehow managed to pay all the EMIs until now but I am unable to pay any further. Ongoing labor case and timeline for visa cancellation
Q: Good evening. I have filed a labour case against my company for arbitrary dismissal and it is still ongoing. Is it alright to travel to my home country or another country even while my case is ongoing? Also, can the employer cancel my visa even while the case is ongoing? We are in a free zone and they said the free zone authority advised that the visa can be cancelled by the company after 90 days from the time the complaint was endorsed to court. Is this correct? Time limitation for claiming the end of service benefits
Q: I had been working for an LLC company in Dubai for 6+ years on an unlimited contract and got terminated due to company restructuring. I had signed my labour cancellation papers as they promised me that they will settle the amount at the earliest and currently working for a different company. My termination happened in Nov 2016 and I had received half the amount of my end of service benefits in instalments.
