Notice period for resignation during probation

Hi,

I am working in Dubai under an unlimited contract. As per the labour contract, the probation period is 6 months and I resigned from the company in Jan.

The notice period is 3 months from both parties but I am not sure if resigning during the probation requires this notice period of 3 months.

Please advise if they have any right to hold my salary in case I resign and leave the company.

Hi there,

The probation period is an advantage regulated favouring the employer but not the employee unless agreed otherwise between you and your employer.

Accordingly, you shall follow the law and terms as agreed in your contract.

Unless your resignation coming under article 121 of the UAE labour law you have to serve a notice and cover the /3/ months notice as agreed in your contract.

Or else your employer is entitled to sue you claiming for compensation.
