Suspension of salary upon resignation to the last working day

I am serving the 30 days notice and on the 23rd day, the payroll cycle came and all employees received their salaries.

Is the employer authorized to suspend the salary until the last working day and include all the amounts in the final settlement?

Dear Sir/ Madam,

Thank you for getting in touch with me on this.

The UAE Labour law states that if an employer withholds salary for more than 2 months, then the employee can complain to the same to Ministry of Labour (then the Labour Court) and obtain compensation for such a delay.

However, in your case, it appears it will be less than 2 months (7-8 days), you can wait until the last day to get your pending salary and EOSB.

If the company is not releasing the salaries even on or post the last working day, then you can file a labour complaint and claim the same.

I trust you will find this appropriate.

You can get in touch with me on 052-9495731 or email for further assistance and clarification.

Regards,

Hari Wadhwana
