Defaulting on a bank loan and facing civil legal action

Q: A bank has filed a criminal case on cheque bounce. I was taken to court and I paid AED 1,000 fines to the court. After this, every month I pay an amount between AED 500 to 1,000 to the bank. Last month, I did not pay the amount, so the bank is threatening me that they will file a civil case and put an immediate travel ban on me. I need your support.

س: القضية مرفوعة من سنة ٢٠١١ وهي كالتالي: استأجر زوجي شقة للسكن عند شخص بدون عقد سنوي، وابنه كان موكل بجمع الإيجارات. وبعد سنة، قرروا بيع العقار ورفضوا استلام الإيجار لكي يرفعوا قضية إخلاء. توجهنا للدفع عن طريق المحكمة، وبعدها بفترة بسيطة تم بيع العقار وكتابة عقد مع المالك الجديد. فوجئنا سنة ٢٠١٩ برفعهم قضية عدم دفع الإيجار بقيمة ٥٠٠ دينار وغرامات تصل إلى ١٢٠٠ دينار ولم نُبلَّغ بأي قضية خلال كل هذه السنوات وموجود تعميم بالمحكمة. حاليًا هو خارج الأردن ولا يستطيع العودة بسبب هذا التعميم. ما الإجراء القانوني لمثل هذه الحالة لأنه ظلم كبير؟ الرجاء المساعدة بأسرع وقت!

Acting against delay of delivery for a purchased property

Q: Hi, My house was supposed to be delivered on 30 Dec 2018 but it`s more than 1 year of delay and still, there is no communication on when it will be delivered. I have paid 30% of my house value in October 2018 + 2% DLD and rest 70% is on delivery as per the agreed payment plan. We are speaking to the builder to get a better picture of the delivery progress of our house but they say they yet don`t have the exact date of delivery. Kindly advise, what should I do? Thanks.

Q: Can I sue my employer for not giving me back my passport? I requested the contract cancellation which I was granted at the labour office, but my employer refused to handover the cancellation paper after I exceeded my 30 days grace period.

Getting a new employment visa while a cheque bounce case is being processed

Q: Hi All, I have an existing criminal "cheque bounce" case under my name for dishonoring loan payments. I`m also a victim of unpaid salaries and gratuity from the previous employer. However, I have reached a stalemate in negotiating with the bank as they are not interested in accepting the money I could offer in the interim despite having a clear understanding of my predicament. Finally, I have an offer from a company after all these months and I`m anticipating to accept this offer but I`m yet to resolve the criminal case! Since the bank is not willing to negotiate, I`ve planned to pay the criminal case removal fee or fine to the Dubai Police. I know that the bank would immediately proceed with a civil case should that happen. My question is how long does it take to file a civil case? And can they initiate a travel ban without appeal while filing the civil case in court? Will it affect my capacity to get a new employment visa stamped and work in the UAE while the civil case is active?

Possibility of changing custody in case of changing country

Q: I am a US citizen (father of a 9-year-old). I recently got divorced and have sole legal and primary physical custody of my child. My wife is allowed only 1 visit with my child (for 2 hours each week, under the supervision of a 3rd person). My wife has unaddressed mental health issues. This is documented in the Parenting Plan and Divorce Decree. If I move to outside the UAE, can my wife again file for revision of custody? Will my US divorce and parenting plan be considered by the courts in the UAE?

س: توجد أحكام غيابية من محكمة الجنح أول درجة ضد متهم في قضايا شيكات بدون رصيد بملايين الجنيهات مجموعها يتخطى 10 سنوات حبس. المتهم هارب في دولة الأردن مع زوجته وأولاده وقام بفتح محلات هناك وعنوانه معروف ولا يملك شيء في مصر. هو متزوج من أردنية ولا ينوي العودة لمصر والإنتربول لم يفعل شيئًا، ولم يحاول القبض عليه أو إعلانه رغم إبلاغهم بكل تفاصيل مكانه في الأردن. مضت على الأحكام الغيابية سنتان، هل هناك إجراء يمنع انقضاء الدعوى الجنائية بعد مرور السنة الثالثة على الأحكام ويمنع سقوط الأحكام؟
