When should I inform the landlord regarding vacating the flat per law?

Thanks for your query, you should first check your tenancy contract to see the specified notice period as stipulated in your agreement. However, you should give the landlord no less than 60 days advanced notice.

It depends on the time mentioned in your tenancy contract. It is usually before 2 months. But if the parties agreed on another term, this has to be mentioned in your contract.

Dear Raluca Gatina,

Thanks for your support. I have one more question regarding the security deposit amount.

As per the contract, I had to vacate the flat on 31st March 2020. On the same day, I had submitted the flat key, the parking access card, DEWA clearance certificate, and even I painted the flat.

Kindly clarify how many days after that I will get my deposited amount as per law.

Dear questioner,

In accordance with the provisions of Article 20 of the Law No 26 of 2007 Regulating Relationship Between Landlords and Tenants In the Emirate of Dubai:

"Landlord may obtain maintenance deposit amount from tenants to guarantee the maintenance of premises at the end of tenancy contract, provided that landlord shall undertake to refund this deposit, or any remaining amount, upon expiry of the contract."

Therefore, you may ask your real estate agent to arrange for repayment of your security deposit at the earliest.

If however, the same does not take place, you may elect to send a legal notice to the concerned agents, and also report the matter to the Real Estate Regulatory Authority, Dubai.

How many days are required to pay the maintenance deposit amount to tenants? ( Example: Before vacating, we have to give 60 days advance notice otherwise landlord can penalize as per law).

So, what is the number of days as per law to repay the deposit amount from the day I vacated the flat?

Dear questioner,

As mentioned above, there is no such term, according to the Law No 26 of 2007 Regulating Relationship Between Landlords and Tenants In the Emirate of Dubai.

The landlord needs to repay the deposit upon expiry of contract - as per the law.

In case they will not refund you the funds, please approach me via email, so we can discuss the next steps.

In the legal notice, you will mention the number of days until he can refund your deposit. If he will not refund the deposit during that period, you can report the matter to the Real Estate Regulatory Authority, Dubai.
