Legal implication of a non-compete agreement
Q: I have signed an internal employment agreement, which states that I cannot work with the competitor if I resigned. "The employee covenant with the company that he will not for a period of twelve months after the date of termination of his employment for whatever reason, be concerned in any the business which is carried on in the UAE and which is competitive with any business which is carried on by the company at the time of termination. The employee shall not after the termination of this agreement directly or indirectly on his own account or on behalf of or in conjunction with any person for a period of 12 months thereafter induce or attempt to induce any employee to whom this subclause applies to leave the employment of the company." What is the legal status of this agreement? This is an internal agreement in English only and has not been attached to the labour contract.May 15, 2019

Consequences of non-renewal of visa and labour contract
Q: Kindly advise what can I do now that my visa already expired (expiry date is 04.04.2019). I keep waiting for my boss to have it renewed as he promised it will be renewed. The grace period is already finished and at this time, I have not received his advised for renewal yet. My labour contract is also not renewed. I am still working with them but I feel like somebody will just catch me as at this time I know I am over-staying. Is filing a resignation and complaining to labour the solution for my situation? I also have a credit card that I agree for a settlement a few months back, but since our salary is always delayed, the bank said they will cancel the settlement and will file a case. How can I check if I really have a case now? Can the police just put me in jail? Hoping you can somehow give me advice.May 14, 2019

Breaching contract by the service provider and possible action
Q: Compensation for poor performance & false accusations. We hired a consultancy agency to provide us with their services. During our working relationship, the deliveries were consistently late, and the service was unreliable. We gave them numerous chances to improve performance and meet timelines. The details of these problems have been communicated to them repeatedly but they did not address the problems in a timely manner, causing us extra expenses in addition to mental and emotional agony. During the project, my father passed away & they have used this matter as an excuse to pause work on the project without notifying us causing us further delays. Recently, we serviced them a notice for contract termination for their failure to adhere to mentioned services. In response, they have wrongfully accused me of talking badly about their staff & making insulting & inappropriate comments about their work which have made the working relationship difficult.
