Resignation from free zone company for the nonpayment of salary

Do I have a ban if I've resigned before my visa was stamped in the passport?

I am working in a free zone company for the last 8 months. Now my employer gave an employment visa. They did my medical but didn't get the Emirates ID and visa is not stamped on my passport yet.

Also, they are not paying my salary for the last 3 months. I want to change this company but If I leave the company they want from me the full visa cost. What should I do?

Please help.

Dear Questioner,

Pursuant to your query, Free zone employees are not subject to a labour ban and the free zone authority is not listed with the Ministry of Human Resources & Emiratisation who applies such a labour ban.

So, if you've resigned there is no such a labour ban on you and you can easily move from one free zone company to another free zone company or you can also move to a mainland company.

An employer may not collect or deduct the employment visa cost from the employee in the UAE. But if the visa cost is mentioned in your contract, then you have to pay for the company.

First, check your employment contract to be sure about this point. You can change your job without being subject to any labour ban.

Please feel free to contact me on phone or email for further assistance and clarification.

Regards.
