Leave pay calculation under the UAE employment contract
Q: Dear Madam. My JAFZA Employment Contract is an unlimited free zone contract. My services have been arbitrarily terminated on 09 Dec. 2018, and after having served the 90 days paid notice period, my tenure ended on 08 March 2019. I am now in the process of finalizing my end of service benefits, and there is a clarification required in regards to the basis of computation of the benefits. Queries are as under. Leave pay due to termination: I have 25 days unutilized leave which I intend to encash. What is the basis of computing the value of this leave pay? Would it be on the basis of: a.) gross monthly salary (which includes the latest basic salary + housing allowance + transport allowances) b.) or on the basis of latest basic salary + housing allowance c.) or on the basis of just the latest basic salary? Could you please clarify and provide me with the correct latest updated UAE Labor Law article ref. # 79 for the correct interpretation of the basis of calculation for the above leave pay.May 20, 2019

Termination of limited term contracts by the employee and its effects
Q: Dear Madam, I am a doctor, working on a limited contract in a private hospital. I finished one contract of 2 years + one more year. I am planning to terminate the next contract in the middle. In the contract, it is mentioned 3 months notice period with 3 months full pay compensation for either party. Non-renewal of a labour contract upon expiry
Q: Good Day Madam!! I am working in this company for the past 4.2 years. I sent my resignation letter through the mail on a Thursday evening, which is a weekend. But I have calculated my 1 month notice period from Sunday onwards. Is this resignation legally valid & accepted? 1 more important info; my previous contract got over on the 20th of Jan 2019. س: معي شيكات مسحوبة على شركة تجارية ذات مسؤولية محدودة بالإمارات وعلمت أن صاحب الشركة والذي وقع على الشيكات لي قد قام ببيعها منذ فترة والشركة الآن تمارس أعمالها التجارية تحت مظلة المالك الجديد. سؤالي، هل سقط حقي في الشيكات ببيع الشركة لشخص آخر أم أنه ليس لي علاقه بهذا وأستطيع تحصيل أموالي حين تقديم الشيكات؟ علماً بأنها مسحوبة على الشركة وليست شيكات شخصية.

Checking and removal of ban and cases from the court
Q: Hi Sir/Mam, I worked in Dubai for 4 years. I changed my last job in 2016. Here, I got few issues related to work with my last employer - where he deliberately tortured me to make submit resignation. At the same time, I was cheated by a real estate company by AED 60000. I am in debt with banks through loans and credit cards and I was in too much tension about the job and came back to India without intimating the company. I did not pay my dues since Nov 2016. Currently, I am residing in India and I want to clear my debts because I don`t want to keep a negative tag and to lift the ban if anything is imposed on me. My friend approached a lawyer who said he will support in clearing my debts through a small amount of fine via court. For this procedure, the lawyer is going to charge 10-15% of the total amount due. Please let me know whether the court will simply knock of my case and remove the ban if I paid the fine to them (or) the lawyer is cheating us. Please help out. Regards, S.May 18, 2019

Dealing with bank loan cases before being contacted by police
Q: Sir, My security cheque of AED 219,000/- was bounced by the bank at Bur Dubai police station. I have not received any call or information from the police station. I took a personal loan of 150000/- I paid 139000/- balance pending is 84000/- with interest. Two days back, I have received an email as a demand notice from the bank for payment of outstanding due 84000/-. What do I have to do in this situation?
