Cancellation of labour contract for delay in salary

Q: Dear Sir, I have a query relating to the cancellation of labour ban on grounds that the company is delaying the salary almost 59 days (1-day short) two months. It has become a habit of the company to delay the salary every month. I would seek the following information: - What are the criteria for breaking the contract on grounds of delay in salary in case I apply for cancellation on the basis of delay in salary? - Shall I have to pay 45 days salary or no?

Q: I have a one-year labour ban starting on May 01, 2019. I came to know from a friend that the labour ban is followed by an immigration ban. How true is it? If I get an offer letter from another employer, will it lift the ban or not? Is there anything that can be done to lift the ban? Authentic answers will be much of help. Thank you!

Custody, guardianship and division of assets in a divorce

Q: I want to divorce my husband; my concerns are as below; If the divorce proceeding is under Sharia Law, what are my chances when it comes to; 1. Child Custody & guardianship - I believe I will get the custody until age 11. My question is if the husband is unemployed for 6 months now, can he still be considered as guardian since he can`t provide for the family? And if I can show that he has never been a provider for the family (basically, I pay ALL the bills since we got married) & I have a proof that he had an affair a year ago, can I get the guardianship as well & full custody? Can the child get an opportunity to choose where he wants to live with when he reaches puberty? 2. DIVISION OF ASSETS - Since I got a land inheritance from my parents, is he entitled to get 1/2 of the property? Obviously, he has no house/properties in his home country as well as savings and I am worried he will get everything. I own 50/50 in which he didn`t sweat a dime on it. Awaiting your advice.

Cancellation of visa after judgment in a labour case

Q: Good noon, I have a labour court case in execution. I got a judgement already that my sponsor has to pay me. My local ran away from the UAE. Also, he did not appear in any of the court hearings. Now I applied for the cancellation of my labour card, but MOL is asking for the sponsor to accept my cancellation. Still, I did not get my settlement. I got the judgement before 35 days. Please assist me, how do I get my cancellation?

س: السلام عليكم، أنا موظفة إماراتية أعمل في شركة خاصة. تعرضت لمضايقات من زميلة في العمل عدة مرات، وعند توجهي لمسؤولي وإخباره عدة مرات يقول لي اصبري ولا يتخذ معها إجراء، وعندما تشتكي هي مني يتحدث معي. يوماً بعد يوم، زادت المضايقات وأخبروني أنهم سيأخذون لي حقي خلال أسبوعين ولم يفعلوا شيئًا. توجهت لوزارة العمل لتقديم شكوى وحل موضوعي. عندما عرف مديري قام بإرسال إنذار أول على الإيميل لأنني توجهت لمؤسسات حكومية وتقدمت بشكوى ضد موظفة. وقد رفع صوته عليّ وهددني أمام الموظفين قائلاً: "إنكِ تضرين نفسك" و"ممنوع تذهبي إلى الوزارة" و"ليس من حقكِ" و"سأتخذ فيك إجراء". بعدها بيوم قام بإجراء "إنهاء خدمة موظف" تجاهي والسبب، عدم اجتياز فترة التجربة ٦ أشهر. علمًا بأنه بعد ما اشتكيت في وزارة العمل قدم لي هذا الكتاب. عملت عندهم من تاريخ ٢/١/٢٠١٩ إلى ٢٦/٣/٢٠١٩. وكل يوم يتصلون بي من الشركة لأوقع على الإلغاء وأنا أريد أخذ حقي.

المطالبة بتعويض عن خطأ طبي لتفاقم حالة مرضية

س: السلام عليكم ورحمة الله وبركاته في سنة 2015 كانت ابنتي تعاني من حمى شديدة ودخلت علي أثرها مستشفى في دبي. وبعد 16 يوماً، تدهورت حالتها للأسوأ مما أدى إلى دخولها في غيبوبة وشلل حركي واضطرابات في المخ والأعصاب خلال تلك الفترة وتم تحويلها إلي لندن للعلاج. بدأت في التحسن نسبياً وتدهورت حالتها خارج البلاد ولكن لم أعرف سبب تدهور حالتها إلى هذا اليوم، والآن تم وقف علاجها في الخارج. للعلم بأنها أجرت 3 عمليات جراحية كبيرة في 10/1/2019 ولديها مراجعة في 10/6/2019 واللجنة الطبية ترفض استكمال علاجها في الخارج. السؤال، من الجهة المسؤولة عن الضرر الذي لحق بابنتي علماً بأنها كانت سليمة ودخلت المستشفى تمشي علي رجليها، والآن هي مشلولة حركياً؟ وهل هذا خطأ طبي أم لا؟ أفيدوني وجزاكم الله خيراً

Q: Good day! I have a loan and credit card with a bank in the UAE which I have defaulted on the payments for the last 8 months because I am unemployed, and currently in India. My security cheque amounted AED 35,000 was deposited and bounced, and now I have a police case and a ban on my name. I got a new job offer and my employer is not able to fix an employment visa for me because of this police case and ban. I tried to get a settlement deal with the NBFC, but it is not ending up with a good deal. So how can I overcome this issue to clear the police case? Legal consequences for non payment of bank dues

Q: Dear Sir My question is that I have two credit cards of a total outstanding amount of AED 60000 including interest and late fines...etc. I am not paying the credit cards payments for the last six months due to financial issues. I contacted the bank for full and final settlement after giving a discount but the bank has not agreed to give a discount and asking to pay the full outstanding amount. Q: Dear Sir, My JAFZA Employment Contract is an unlimited free zone contract.
