The consequences of terminating a limited contract by the employee

I am working in Jebel Ali Free Zone with a limited contract.

As per my offer letter I have to serve the notice period of 60 days and 45 days of basic salary. But I came to know my employer is charging 45 days of gross salary after serving the complete notice period.

Just wanted to check, is it legal to ask for 45 days of gross salary in case I serve the complete notice period?

Thanks for writing to me.

Please note that if you're on a limited contract, resignation is a breach of your contract. You can only leave the job with the consent of your employer or after your contract period.

As per the law, there are no stipulated notice periods in limited period contracts because as mentioned above, you are obliged to complete the contract period.

Resignation before the same is considered a breach of the contract, against which the violating party shall compensate the other.

If the employee is terminating, the compensation is calculated as 45 days gross salary.

Even after serving the notice period, you're obliged to compensate the employer as a penalty to the breach of the contract terms.
