س: السلام عليكم ورحمة الله، أعمل في فندق بأبو ظبي، وبسبب مشاكل صغيرة تلقيت من المدير ورقة الفصل من العمل. لم أوقع وفي اليوم التالي عندما كنت في الدوام، أحضر لي المدير بعض أفراده ممن يشتغلون في الشرطة لكي أخاف وأوقع على الورقة ولم أوقع لمدة ٣ أيام متتابعة يحضرون لي الشرطة ولا أوقع. بعد ذلك طلب المدير من حراس الأمن منعي من دخول الفندق. لم أستلم رواتب ولا أي شيء منذ شهر ١٢، كنت أذهب إلى الشغل ويجبروني على الرجوع ويطردونني ويقولون لي سوف نلغي إقامتك حين يفتح الطيران إلى بلدك. بعد ٣ أشهر أو أكثر من العذاب مرضت فيها، تفاجأت أنهم ألغوا بطاقة العمل من طرف الشركة ووقَّع المدير في مكاني ولم أستلم رواتبي. مع العلم أنني كنت أذهب يوميا إلى الفندق وهم يطردونني وكنت أدخل أوقّع مقابل بعض الكاميرات. عندما عرفت أنهم ألغوا بطاقة العمل، ذهبت إلى المدير ولم أخبره أنني أعرف كل شيء. تحايلت عليه وإذا به يعطيني أوراق الإلغاء لكي أمضيها. جميع الأوراق مستندات إلغاء حقيقية وتحمل توقيعه بتاريخ هذا الشهر. أخذت الملف ورحلت وهو معي. ماذا أفعل في هذه الحالة لآخذ حقي؟

س: السلام عليكم، اتفق طرفا التعاقد في عقدٍ ما على أن تكون محاكم دبي - على سبيل المثال - هي صاحبة الاختصاص القانوني للنظر في أي نزاع قد يحدث. إذا كان المدَّعى عليه مقيم في إمارة أخرى غير دبي وتم توقيع العقد في إمارة أخرى أيضًا غير دبي، فهل سترفض محاكم دبي الدعوى لعدم اختصاصها أم أنها ستقبلها باعتبار اتفاق الطرفين في العقد على أن تكون محاكم دبي هي صاحبة الاختصاص القانوني للنظر في أي نزاع قد يحدث؟

Q: Hi, Firstly, thank you for this service. Let me briefly describe my situation. Been in Dubai for a long time. Lost my job recently and frantically applying for a new one. Currently on garden leave until June, so only 2 more salary payments are pending. I have a loan for AED 950k and an outstanding mortgage of 900k (the value of the property is 2m AED. Afraid that after June I will not keep up with payments on the loan for sure which are 33k per month. س: السلام عليكم، لدي قضية عمالية صدر الحكم فيها لصالحي. طالبت بدون علم في بند التعويض عن الفصل التعسفي في المذكرة بالتعويض عن شهر واحد ولكن عقدي محدد المدة وأقرت المحكمة أن لي الحق في التعويض عن مدة 3 أشهر ولكنها تقيدت بما طلبت لذلك حكمت بشهر واحد. هل توجد طريقة أو طلب لإعادة النظر في قيمة التعويض والحكم بالتعويض المناسب دون التقيُّد بالقيمة المطلوبة؟

How to check possible cases and travel ban after leaving with a pending loan?

Q: I have a car loan with a bank (Emirates Islamic) in the UAE and I have defaulted on the payments in 2015. because of the fraudulent activity of my company partners, I had to leave the country resulting in leaving the blank signed chequebook there in my office. I just need to check whether I have police cases and a ban on my name. I tried to get a car loan settlement deal with the bank, but it is not ending up with a good deal.
