What is the grace period to file a case for labor rights after resignation?
Hi Sir/Madam,
I want to know what happens when I resign after I completed the probation period.
My company did not cancel my visa and did not pay me my gratuity and pending money.
It's almost 4 months and my visa is valid till December.
So how long do I need to wait? Or what is the maximum time to go to court for filing a case?
Is there any time period or I can go after 5 or 6 months?
Please guide me.

As per the law, you have a deadline of 1 year for filing labor claims.
So, you can file your case within 1 year of your resignation.
However, if your visa will expire in December, it is best for you to file the case in advance of your visa expiry so that you will not have any immigration issues.
