Application of the VAT rules on influencers in the UAE

Q: We all know that influencers are subject to 5% VAT in the UAE for conducting online promotional or marketing services. But the question that no one has answered is, are the following subject to VAT in the UAE: 1- Google AdSense revenue generated from posting videos on youtube? 2- Affiliate marketing revenue paid by international affiliate networks? If yes, can influencers register to FTA directly without a company? Because having a company will result in paying newly introduced corporate tax if I`m not mistaken!

Q: Good morning. My wife is Philippino national and I am a UK national working in Dubai. In March 2016, my wife was arrested and charged with the Abuse of Psychotropic Substances. She was sentenced to 1 year in jail. After 6 months she was deported back to the Philippines (September 2016) and is now on the immigration blacklist, I have had this confirmed. At that time she was single, we met later. I understand it is legally possible to get her name removed from the immigration blacklist, but my question is have the UAE courts ever lifted an immigration ban for someone jailed for a drug offense? I understand the law is rarely ‘black and white’ but would appreciate a legal view. Obviously, I would like my wife to join me here in Dubai and I’m just trying to understand if this is actually feasible or we should just accept that we will have to live apart while I work in the UAE.

س: السلام عليكم، أودعت مبلغ من المال في حساب شركة حاضنة أعمال في الإمارات لغرض الاستثمار في شركة (لم تُؤسَّس بعد ولم تصدر لها رخصة تجارية). استلمت ورقة "سند قبض مبلغ للاستثمار في الشركة التي لم تؤسس ولم يوقع عقد شراكتها". بعد فترة طلبت الانسحاب للتأخير في تأسيس الشركة المراد الاستثمار فيها. أبلغوني أنهم صرفوا مبالغ من المال الذي أودع لغرض عمل دراسة جدوى وتأجير المكان، علمًا بأن المبلغ صُرف بدون إذن مني ولا يوجد اتفاق مسبق بشأن الصرف قبل توقيع عقد الشراكة. هل يحق لحاضنة الأعمال التصرُّف في المال لعمل دراسة الجدوى، التي لم تُعرَض عليّ إلا حين قررت الانسحاب، بمجرد إيداعي المبلغ واستلام سند قبض مبلغ الاستثمار؟ علمًا بأن هناك مستثمرين آخرين وضعوا أموالهم أيضًا لغرض الاستثمار في مشروع الشركة ذاتها.

How to file a complaint against a humiliating call from a company agent?

Q: Do I have the grounds for filing a legal action? I just got a sales call from a trading company and I kept repeating over and over to the sales agent that I am not into trading at all with zero chances of me doing it. So she replied saying "and do you think that everyone else is like you dumb and stupid?" before hanging up the line in my face. Obtaining a new visa while a labor case is running

Q: Dear sir/madam, I filed a case against my employer on Apr-21 for arbitrary dismissal. I won the case in the first court and second court. Even the report from the expert appointed by the court was in my favor. I filed for execution which was appealed by my employer, but they lost the appeal as well. During Jul-21, I obtained NOC from the court to work elsewhere (my wife’s company) and got a 1-year temporary work permit to work during this time. The employer has further appealed to the supreme court on Apr-22. My questions are: 1. My visa is expiring in Jun-22 and I want to travel in Jul-22. I am afraid the judgment may not come until then. I want to cancel my current visa and obtain another visa (under my wife`s sponsorship as she holds Golden Visa). What is the procedure for cancellation? And will it have any adverse impact on my case or new visa application? 2. Will the employer be liable to pay the execution order amount as they have lost the appeal? Many thanks in advance!

Q: Greetings, I have given a power of attorney to my daughter authorizing her to operate the bank account/sell shares of the company which I own in Dubai, etc when I am not able to do so, and upon my death too. How to get pending labor dues if no company assets can be found during execution?

س: السلام عليكم ورحمة الله و بركاته، حصلت على حكم قضائي حضوري صادر من دولة الإمارات العربية المتحدة وهو عبارة عن تعويض مدني وقد استنفد كافة درجات التقاضي ولدي شهادة تثبت عدم الطعن على حكم الاستئناف. قمت بقيد ملف تنفيذ في الإمارات ولكن المنفَّذ ضده سافر إلى مصر ولن يعُد. هل يجوز تنفيذ الحكم على المنفَّذ ضده عن طريق محاكم جمهورية مصر العربية؟ إذا أمكن ذلك، فما الإجراءات والأوراق المطلوبة لذلك؟ مع خالص الشكر والتقدير!
