س: السلام عليكم، انتهى عقد الإيجار منذ أكثر من سنتين، وتم التمديد ودفع كافة المستحقات حتى تاريخه. استلمت إنذار من محكمة رأس الخيمة بالإخلاء لعدم تجديد عقد الإيجار ومبلغ ٣ أشهر فقط مستحق، على الرغم من أن عدم تجديد العقد كان تقاعسًا من شركة العقار، لذلك تم التمديد ٣ أشهر بعد ٣ أشهر إلى آخره حتى تاريخه.

بعد الموافقة على صرف مبلغ في محكمة التنفيذ لصالحي، ماذا أفعل؟

س: السلام عليكم ورحمة الله وبركاته، بعد الموافقة على صرف مبلغ في محكمة التنفيذ لصالحي، هل يتوجب علي اتخاذ خطوات أخرى؟ مع العلم أنني قدمت طلب صرف مبلغ وتم استلام المبلغ من محكمة التنفيذ وقد أرفقت رقم حسابي البنكي للمحكمة وتمت الموافقة على صرف المبلغ.

I'm being charged more rent after a one-time offer. What can I do?

Q: Dear Sir/Madam, Last year, I received a one-time offer while signing the contract. The original price was 45,000 dirhams, but I received a 6,000 dirham discount, so I am currently paying 39,000 dirhams for my apartment. I received a 90-day notice that my rent will now be 48,900 dirhams. Can someone tell me what numbers I need to use to calculate my new rent? Is it legal to increase my rent in this way? The company claims that the price is based on the rental index calculator.

Can I terminate the SPA for an off-plan property and get full refund if I didn't receive the SPA?

Q: I booked an off-plan property with a developer in a project in Dubai. I have paid 10% + 4% DLD. It`s been 2 months and still, I don`t have SPA. Plus, the above amount is in favor of the developer`s account and not escrow. Please advise if this is normal and what questions I should ask the developer. Can I withdraw the money from the developer? Will he be liable to hold any % of my money for cancellation?

What can I do if my company gave me bonus less than the amount we agreed on?

Q: I work in DAFZA. My company does business in USD. My company gave me a target letter that if I did X amount in Euros, then I`ll get AED 57K as an incentive. I managed to do 102% and was expecting an incentive payout accordingly. But they gave me a bonus as per 94% target achievement. They mentioned that the exchange rate was favorable all throughout the year for USD. But if they calculate the sales at the original exchange rate used while deciding the target, I have achieved only 94% of my target. 2 things: 1. They never mentioned in writing anywhere that the final calculation would be based on the fixed exchange rate. 2. Target versus Achievement as per our ERP system, which I used for tracking my achievement status showed me the result as per the actual exchange rate on that day and hence I assumed that I hit 102%. No one pointed out in the whole year that my achievement was not 100% and there`s is nothing in writing reflecting that. How can I ensure that my company pays me the correct amount?

Can I make a payment for a company that sent me an offer letter as visa expenses?

Q: Hi there I would like to ask. I got a job offer from this company Alsamira Construction & Petroleum LLC Company (https://alsamira.com). They also sent me the JOB REFERENCE NUMBER. They want me to pay for the visa work permit but in the offer letter, it says that it`s a free flight and visa. EXPENSES: It is understood that the employee will incur expenses to get his/her valid UAE Residence/Work Permit while the Alsamira Construction & Petroleum LLC. The company (Alsamira Group) shall make the required arrangements for the employee’s free flight ticket and visa and reimburse the employee for any other moving expenses after he/she presents an expense report and itemized account of expenditures, pursuant to Alsamira Construction & Petroleum LLC Company (Alsamira Group) and will be reimbursed not later than Five (5) working days after submission of the employee’s expenses, reports and receipts. Can you please give me some advice on what to do?

Can the MOU with the property buyer be extended after expiry without my approval?

Q: Hello, I have signed an MOU without any deposit and the MOU expired today. The broker and buyer did not turn up to close the deal and the MOU expired today. I spoke to another broker but he said that while raising Form A, it`s showing Contract F exists. Earlier it was showing to him Active Contract F exists but now after the expiry of the MOU, it is showing that Contract F exists. How can this expired MOU be still effective?

Can the landlord force me to pay rent increase if he sent the notice after the 90 days period?

Q: The landlord wants to increase the rent but didn`t give me the 90 days notice. He claims it is according to the RERA law, but I insisted that he didn`t give me the notice, so he can`t do that. Q: Hello, I made an EOI payment for one project with a developer in Dubai. In the agreement, it says if the seller is able to allocate the unit similar to the buyer’s requirements, in this case, it’s not refundable. However, I am not happy with the unit and it doesn’t meet my requirements. For example, the view of the unit and the fact that it is on the last floor, the last floor doesn’t work for me although I requested a high floor. And the unit has a city view although I requested a garden/park view in the EOI. At this point, I canceled the purchase and asked for a refund to which I got a response that according to the terms and conditions of the EOI, it is not refundable which is not correct. My requirements for the unit do not match the unit they allocated. What are my rights? Please advise. Thank you.
