Q: I'm Jordanian and my wife as well. We have a daughter who's 1 year and 6 months old.
My visa got cancelled as well my daughter's and I asked my wife to come back to Jordan but she refused and kept my daughter and hid her passport. I'm now in Jordan.
Can she file a divorce case against me even if I'm not in the UAE anymore?

Q: Hi.
I am in India for the last 5 months and still hold a valid UAE visa. My wife is staying in Dubai and has applied for mutual divorce in Dubai Courts. We are married since 2008 and have no children.
Can my wife be granted a divorce in my absentia (ex parte) under the Hindu marriage act?
If so, how soon can this be done as we both need the divorce and I am unable to travel to Dubai?

Understanding the rights of a husband before divorce

Q: I'm an Indian Muslim expat living and working in the UAE. My marriage was solemnized in India. We also have a two-year-old son.
Due to irreconcilable differences, I have informed my wife and our families that I wish to file for divorce. My wife has a residence visa valid till May 2019 but she (and my son) have not been in the UAE since December 2018.
As I live and work in the UAE, I want to file for divorce here. While my in-laws are ok with a mutual consent divorce in India, my wife will not be returning to the UAE.
I would prefer to file for divorce in the UAE as I'm not familiar with the law in India. I also don't want to deal with any potential false charges that could hamper my ability to come back to the UAE.
While my in-laws have not indicated any such actions, I want to prepare for the worst-case scenario. I also would want to have legal visitation rights to him, even if he lives in India post-divorce.
Can any lawyer help me understand my legal options in this case?

Possibility of filing for divorce if the wife is outside the country

Q: My husband and I are married for 11 years. We lived our life in Dubai till January 2019.
I moved back to Germany with our 3 kids. My husband wanted to follow us at the end of 2019. Now, he wants a divorce out of a sudden.
Can he proceed with the divorce in the UAE without me being present?
What are my rights and what can I expect in terms of child support and custody?
He had been married under the sharia law back in 2008.

Q: As a non-Muslim British citizen with residency in the UAE, can I file for divorce in the UAE from my partner who is a British citizen and resides in the UK?
They have never had a work or residency visa in the UAE. How would I start this process and how would they be notified?
Can I avoid notifying them? What are the benefits if I were to file a divorce petition in the UAE compared to the UK?

How to settle a divorce case in execution with ex-husband who is outside the UAE?

Q: I got my divorce executed last year from Dubai & my ex hasn't come back to Dubai yet.
Now he is pleading to remove the execution case but I don't trust him a bit because he doesn't want to pay a penny.
He says he will come to Dubai & settle whatever. I don't trust him. What should I do?

How can I reach a settlement with the bank for a mortgage of a jointly owned property? 0
I have a jointly owned property in Abu Dhabi. The mortgage was defaulted on as I had to leave the property with my children following an assault by my ex-husband. He left the country in 2018 and never paid the mortgage.
As I was in the country, the bank filed a criminal case against me, and I was sentenced to 3 years. I won the appeal against the bank and then filed another criminal case a few months later in Dubai. Again, I won and paid a fine.
In 2019, the bank started a civil case against me and my ex-husband to have the property repossessed. However, at the time of the purchase of the property, there were no Title Deeds, the bank requires this.
I cannot give them the Title Deeds to sell the property and pay back the amount owed to them as my ex-husband refuses to provide a POA. The bank has filed another criminal case against me only for our jointly owned property.
I wish to resolve this and pay off the bank and receive any money left from the sale. How can I resolve this issue of the Title Deeds?

Can a real estate agency hold a percentage of a property sale until transfer is done? 0
A real estate agency has signed an MOU stating that a 10% security deposit from the buyer and the seller will be kept in the real estate agency and will be released upon transferring the property.
The transfer of the property was blocked due to the court order.
According to my colleagues, the real estate agency is not a trustee and they are not allowed to have taken my security check in the first place, is this correct?
