The procedures for filing for divorce on mutual consent

Dear sir/madam,

I am separated from my wife due to compatibility reasons. We got married in the Indian consulate in Dubai on December, 23rd.

We would like to file a divorce on mutual consent as soon as possible. May I get some advice here on the procedures?

Dear questioner,

You will have to file an application for divorce online on the online portal of the family court. You will have to have all the details about you, your spouse, and your marriage certificate in hand together with your Emirates ID numbers.

Upon completing the application, you will be notified and given a reference number for your application by SMS and by email.

In one or two days, the court will respond by giving you the date and time for the first hearing before the family counselor.

Someone will get in touch with you and your wife trying to see if there is any chance not to go for the divorce and to make sure the consent to the terms of the divorce is mutual and agreed upon.

You will be requested to prepare a legal document that will act as the divorce agreement that will regulate the relationship after divorce in case there will be custody, alimony, and other subjects to agree upon.

There will be a second hearing where you and your spouse will have to appear personally before the judge to sign the agreement - which should be brought and drafted by yourself in form of a word document - as well to sign it before the court.

You can contact me directly via email if you wish to get assistance drafting your divorce agreement or if you will require a review of it.

Please note that the agreement must be presented in Arabic or legally translated to Arabic in case you do not speak the language.
