Q: I recently purchased a property in Springs which is rented till September. I need legal advice on the procedure to send an eviction notice to my tenant as I need to occupy the property for personal use. As far as I read in the RERA legislation Page 108-110, Article (25) - Section - 2, if the landlord wants to occupy the property for personal use, 90 days notice is sufficient. But the tenant insists to have a 12-month notice. What are my options and is it possible to send a legal notice to the tenant to vacate the premises at the end of the rent contract? Kindly advise

Q: Dear Sir/Madam, I have a question about rental renewal and would appreciate your response. The landlord did not give us any notice of rent increase or renewal before the 90-day expiration of the contract. However, I gave the landlord written intent-to-renew notice by email before 60 days of the rental expiration. They explained on the phone that they would like to renovate the villa and therefore will not be renewing the rental contract. Can you please confirm what is the minimum notice period that the landlord needs to provide for eviction if they want to renovate the villa? And can they refuse to renew the contract even though they did not serve the notice 90 days before the expiration of the contract?

Q: My landlord wants to evict me (60 days notice) because he wants to sell the property. I told him that he has to give me a 12 months notice which he sent and we received. He also wants to increase the rent above the RERA Index Calculator. I informed him that I am not willing to pay the increase above RERA calculator and also because he did not give us a 3 months notice for the increase and asking me to leave in 2 months. He does not want to renew the contract saying I did not confirm to him my intention to stay (as per contract it says 2 months notice to be given by the tentant or landlord if they want to stay or leave) and that I should leave in 2 months. The relationship between tenants and landlords is regulated in Dubai by Law No. 33 of 2008 Concerning the Relationship Between Landlords and Tenants in the Emirate of Dubai. The provisions of this Law apply to real property leased out in the Emirate of Dubai, including vacant and agricultural lands, but excluding hotel establishments and real property provided by natural or legal persons as accommodation to their employees at no charge.

This Decree establishes a specialised judicial system to hear rent disputes and develops the procedure for determination of such disputes through an expeditious and simple process for the purpose of realising social and economic stability for all persons involved with the real property rental and other related sectors.
