Can the landlord evict me or increase the rent by sending a two months notice for that?

My landlord wants to evict me (60 days notice) because he wants to sell the property. I told him that he has to give me a 12 months notice which he sent and we received.

He also wants to increase the rent above the RERA Index Calculator. I informed him that I am not willing to pay the increase above RERA calculator and also because he did not give us a 3 months notice for the increase and asking me to leave in 2 months.

He does not want to renew the contract saying I did not confirm to him my intention to stay (as per contract it says 2 months notice to be given by the tentant or landlord if they want to stay or leave) and that I should leave in 2 months.

I am aware that he knows we want to stay since we are discussing rent and eviciton in 12 months the landlord is using this now to evict us. We want him to be fair and want to understand our rights.

Your position is legally correct, and the position of the landlord is incorrect.

If he refuses to renew the lease at the current value, file a case against him at the Rental Dispute Resolution Center.

We have received the 12 month eviction notice and will honor that. But he has written an email saying he will not renew the contract because we did not inform him 2 months in advance of our intention to stay as per our terms and conditions in the contract.

He is well aware of our intention to stay since we were discussing rent and 12 months notice and we have never told him our intention to leave.

Also in the past he has never asked for the same. He is using this now to evict us when he knows we don’t want to leave.

We don’t think this is fair and think we are being hassled. Should we go to RERA?

Yes, you have to go to the Rental Dispute Settlement Center at the end of the contract.

Regarding eviction the owner needs to serve the tenant 12 months notice by law.

If the owner gave you less than this period, reject his request.

Regarding increasing the rent, it will be the same as mentionedabove except for the notice period which should be 90 days.

The landlord must serve you a 12-month notice in order to evict you from the property.
