Questions & Answers
My husband left me and my kids without financial support. What can I do?
Good day.
My husband left me and my kids. He is British. I’m Asian. He is still in Dubai.
I asked him to put in writing the financial support that we would get without divorce as the solution. What document should I process?
Also, my kids are British. Is it possible to get my UK visa through them?
I only have a tourist visa but not residency as I understand we have to live there for 5 years. I don’t have any means to support myself when we get there.
I’m unemployed at the moment and even if I work here it wouldn’t be enough for the 3 of us.
Thank you!

According to UAE law, a husband is legally obligated to financially support his wife and children, even if they are separated.
In order to ensure that you and your children receive the necessary financial support, you can file a case with the Family Guidance and Reconciliation Section at the Dubai Courts.
This will require you to provide proof of your marriage and your husband's residency status in the UAE.
As for your UK visa, you may be able to apply for a visa through your children if they are British citizens.
However, this will depend on the specific requirements and regulations of the UK immigration system.
It is recommended that you consult with a legal professional or the UK embassy in the UAE for more information on this matter.

Regarding your husband providing financial support without pursuing a divorce, you can draft a legal document known as a Separation Agreement.
This agreement outlines the financial responsibilities and support he must provide for you and your children.
It is crucial that this document is legally binding and enforceable in Dubai, so it is advisable to have it drafted or reviewed by an attorney.
As for obtaining a UK visa through your children, since they are British citizens, you may be eligible to apply for a Parent of a British Child Visa.
However, this visa requires meeting certain criteria, including demonstrating that you are the primary caregiver and showing that there are adequate financial means to support yourself and your children without recourse to public funds.
Given your current situation, you may need to explore additional support options or financial aid.

Dear Questioner,
I'm sorry to hear about the challenges you're facing. Let's address each of your concerns:
1. Financial Support Agreement:
To formalize an agreement for financial support from your husband without getting a divorce, you may consider drafting a legal document known as a "Maintenance Agreement" or "Spousal Support Agreement."
This document outlines the terms and conditions of financial support that your husband agrees to provide for you and your children.
It's essential to consult with a lawyer who specializes in family law in Dubai to ensure that the agreement meets legal requirements and protects your interests.
2. UK Visa for Yourself:
As your children are British citizens and you are their parent, you may be eligible to apply for a UK visa through them.
There are various visa options available depending on your circumstances, such as a "Family of a Settled Person" visa or a "Parent of a Child at School" visa.
These visas typically require you to demonstrate your relationship with your children, your intention to live with them in the UK, and your ability to support yourself financially.
Consulting with an immigration lawyer or exploring resources provided by the UK government's Home Office can help you understand the visa requirements and application process.
3. Financial Support:
In addition to formalizing a financial support agreement with your husband, you may also explore other sources of financial assistance or support.
This could include seeking assistance from local charities, community organizations, or government agencies that provide support to individuals in need.
Exploring employment opportunities, vocational training programs, or educational opportunities may also help you become more financially independent in the long term.
It's essential to seek guidance from legal and immigration professionals who can provide you with personalized advice based on your specific circumstances and help you navigate the legal and logistical aspects of your situation.
Remember that you're not alone, and there are resources and support available to help you through this challenging time.
