How can I take my kids to home country to protect them from my abusive husband?

Dear Sir/Madam,

My husband is refusing to renew my residency, and without it, I will lose my job by the end of this month. Since he wants me to go back to Nigeria, I asked him to allow me to take my kids, but he refused.

I can't leave the kids alone in Dubai because he constantly abuses them physically, verbally, and psychologically. When he is angry, he beats them with a drumstick even when they do nothing wrong and threatens to send them to a village in Nigeria to work on his dad's farm.

He slaps them hard, and the boys cry to me for comfort. He asked them to call me a witch and a bad person. When I was not working, he beat me constantly, saying it was because I was lazy and refused to get a job, despite my explanation that I had been trying.

I need legal advice on how I can be allowed to take the kids with me back to Nigeria. Please, I want to find out what I can do.

Dear Questioner,

Thank you for reaching out and sharing your distressing situation!

I am truly sorry to hear about the challenges you and your children are facing.

Given the severity of the circumstances, it is crucial to address both the issue of your residency and the well-being of your children as soon as possible. Here are some initial steps and legal advice:

- Residency Renewal:

If your husband refuses to renew your residency, you may be able to apply for a renewal independently under certain conditions, especially if your employment depends on it. We can explore legal avenues to ensure your residency status is maintained.

- Protection for Your Children:

Given the reports of abuse, it is imperative to ensure the safety of your children. You have the right to seek legal protection for your children against abuse. This can include filing for a protective order and reporting the abuse to the relevant authorities in Dubai.

- Custody and Relocation:

To obtain custody of your children and permission to relocate them to Nigeria, we need to present a compelling case to the court demonstrating the abuse and the threat to their well-being. Dubai courts consider the best interests of the child in custody matters, and your evidence of abuse will be crucial in this process.

I recommend we discuss your case in detail so I can provide specific legal strategies tailored to your situation.

Please reach out to me directly via WhatsApp or phone [------] to schedule a consultation. You can also email me at [------].

Your and your children's safety and well-being are my top priority, and I am here to help you navigate this challenging time.

Dear Questioner,

I'm deeply sorry to hear about the difficult situation you're facing. It's essential to prioritize the safety and well-being of both yourself and your children. Here are some steps you can consider taking:

1. Seek Immediate Help:

If you or your children are in immediate danger, contact the police or emergency services in Dubai for assistance. They can provide protection and support in situations of domestic abuse.

2. Legal Assistance:

Consult with a lawyer in Dubai who specializes in family law and domestic violence. They can advise you on your legal rights and options for protecting yourself and your children, including obtaining a restraining order or seeking custody arrangements.

3. Documentation:

Keep records of any instances of abuse or mistreatment, including dates, times, and details of the incidents. This documentation can be valuable evidence in legal proceedings or when seeking assistance from authorities.

4. Domestic Violence Shelters:

Explore the possibility of seeking refuge at a domestic violence shelter in Dubai or nearby. These shelters offer safe accommodation and support services for individuals and families experiencing abuse.

5. Child Custody:

In cases of domestic violence, courts may prioritize the safety and well-being of the children when making custody decisions. Your lawyer can help you petition the court for custody arrangements that protect your children from further harm.

6. Support Networks:

Reach out to trusted friends, family members, or support organizations for assistance and emotional support during this challenging time. You do not have to face this situation alone.

7. Safety Planning:

Develop a safety plan to protect yourself and your children in case of further incidents of abuse. This may include identifying safe places to go, establishing a code word or signal with your children, and keeping important documents and belongings readily accessible.

It's important to take action to protect yourself and your children from further harm. Do not hesitate to reach out for help and support from professionals and support networks in Dubai. You deserve to live in safety and peace.
