Can a mother sue in the UAE to regain custody after her ex-husband took their child from Jordan?

Hello,

I know a divorced couple where the mother holds custody of the child. They are both from Jordan. The father took the child and left to the UAE.

Can the mother file a lawsuit against the ex-husband in the UAE since he is there?

Yes, the mother can initiate legal proceedings in the UAE if the father has taken the child without her consent, particularly if she holds legal custody according to the terms of the Jordanian custody arrangement.

Dear Questioner,

You can file a lawsuit if custody is proven by an official document issued from the state of Jordan. An enforcement file can be filed.

In case there is no court judgment, you can file a new lawsuit and request travel permission for the minor.

Thank you for reaching out with your question!

Since the mother holds legal custody of the child, she may be able to file a legal case in the UAE to reclaim custody if the father took the child without her consent.

The UAE has laws that address custody disputes, and if the child has been brought to the UAE against the custodial agreement, the mother can take legal action to protect her rights.

However, the specifics of jurisdiction and international family law can be complex, especially when both parties are from Jordan.

The mother would need to file a case in the UAE courts, and I can help guide her through this process, including filing any necessary legal paperwork and representing her interests.

I recommend discussing the details further, as this is a delicate matter involving international law.

Please feel free to reach out to me directly via WhatsApp or phone at [--------], or you can email me. I’d be happy to assist you with the next steps.

Looking forward to hearing from you!

Good morning!

Yes, the mother can file a lawsuit against her ex-husband in the UAE to seek custody of their child.
