What law can I seek to apply for non-Muslim divorce and alimony in the UAE?
Does Dubai follow the federal decree law no. (41) of 2022 for divorce?
I am a non-Muslim Filipino and have been separated from my estranged wife for almost 6 years now.
In case Dubai does not follow this new law for divorce, can I file the divorce in Abu Dhabi even if I am a Dubai resident?
Will I have to pay alimony?
Federal Decree-Law No. 41 of 2022 and Abu Dhabi Law No. 14/2021 provide legal frameworks for non-Muslim divorce in the UAE.
The decree enables either spouse to seek divorce without proving fault, and the process becomes effective upon court judgment and notification.
After divorce, a woman can apply for alimony, with the court determining the amount and duration based on various factors.
Amendments to alimony can be made annually or in response to changes in circumstances.
This law will be applicable to the emirate of Dubai. In the case of Abu Dhabi, there is a separate one in the case of non-Muslims.
