Q: My landlord served me a 1-year eviction notice stating to vacate the property for personal use. But he sold the property last month without even notifying me. Now, the new owner contacted me and reminded me to vacate the property as per the old landlord's eviction notice. Do I really need to vacate the property? Or do I stand a chance to object to the validity of the eviction notice on grounds that the eviction notice was served stating personal use but in reality, the landlord had sold it?

Q: Hello, Landlord sent an eviction note by email asking to confirm it by email as well. I already confirmed by email that I received her email. It has been 12 months and she is claiming that she wants to move into the apartment. I read several threads; some say that her claim does stand as it is similar to registered mail, while others say it has to be an official registered mail. From common sense, the landlord did get a confirmation that the tenant acknowledges receipt of the intent of eviction. From a literal legal perspective, she did not use registered mail. I suspect that this situation is frequent and I would like your experience based on what is recently happening in courts, and not only an interpretation of the law, as the concern is that two judges might interpret this part of the law differently.

Q: Dear Sir/Madam, I have received a notice through Dubai courts from the landlord stating that he does not want to renew for the purpose of "Personal Use," as mentioned in the notice. He brought his family for viewing as well. After a couple of weeks of the notice, he sent me a WhatsApp message saying that he wants to show the house to other viewers because he is willing to sell.Is the notice I received still valid? Should he send me a new notice mentioning that he wants to sell? Does the current notice force me to leave the house in case he sells it before my contract ends?

Q: My rent contract ends on 9/8/2024. I contacted the landlord for renewal and he asked to increase the rent. He didn’t send any notice for an increase before 90 days, so I declined the requested increase. He called and said I should accept the increase or I have to leave. Since I asked before in an email to share a copy of his EID, he used the same email subject to share the eviction notice. Can he do that before the contract renewal? Can he send the eviction notice through email or should be through registered mail? If emails are accepted, can he send them under another email subject (subject used: a copy of EID or passport)? The relationship between tenants and landlords is regulated in Dubai by Law No. 33 of 2008 Concerning the Relationship Between Landlords and Tenants in the Emirate of Dubai. The arising rental disputes are referred to Rental Disputes Settlement Centre (“RDSC”) created by Decree No. 26 of 2013 to reconcile between the parties and reach an amicable settlement or seek a final judgment issued and enforced by the RDSC.

Provisions of this Law supersede articles (2), (3), (4), (9), (13), (14), (15), (25), (26), (29), and (36) of Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai. 

The provisions of this Law apply to real property leased out in the Emirate of Dubai, including vacant and agricultural lands, but excluding hotel establishments and real property provided by natural or legal persons as accommodation to their employees at no charge.

This Decree establishes a specialised judicial system to hear rent disputes and develops the procedure for determination of such disputes through an expeditious and simple process for the purpose of realising social and economic stability for all persons involved with the real property rental and other related sectors.
