My sister passed away, leaving her son. How can I transfer his visa to my name?

Hello,

My sister passed away and left her son. Her husband has given me power of attorney and a legal heir certificate.

How can I transfer the son's visa to my name in the UAE?

Hello,

As per your query, please note that if your sister has left any company or property, you must first obtain a succession certificate from the court in the son's name, and then you can proceed with the visa.

Hello,

1. Go to an Amer center or the General Directorate of Residency and Foreigners Affairs to submit the application, attaching:

- Copies of passports and residency permits;

- Original power of attorney;

- Death certificate;

- Birth certificate;

- Copy of the child's passport; and

- A personal photo of the child.

2. Obtain a Personal Sponsorship Application

Sometimes, a "humanitarian" sponsorship visa is issued for the child if sponsorship through the regular system is not possible.

According to UAE law, the legal guardian of a child is responsible for obtaining and maintaining their residency visa.

In this case, as the legal heir and guardian of your sister's son, you have the right to apply for his residency visa under your sponsorship.

To do so, you will need to submit the following documents to the General Directorate of Residency and Foreigners Affairs (GDRFA):

1. A copy of the child's passport;

2. A copy of the child's birth certificate;

3. A copy of the death certificate of the child's mother (your sister);

4. A copy of the power of attorney and legal heir document;

5. A copy of your passport and residency visa;

6. A copy of your Emirates ID;

7. A copy of your employment contract or proof of financial stability;

8. A copy of your tenancy contract or proof of residence in the UAE;

9. A completed visa application form; and

10. A fee for the visa processing.

Once the visa is approved, you will need to visit the GDRFA office with the original documents for verification and to complete the visa stamping process.

Good morning,

Thank you for reaching out!

To sponsor your nephew's visa in the UAE, you will first need to establish legal guardianship or custody over him, which may require obtaining a court order.

Once you have the necessary guardianship documentation, you will need to gather the required documents, such as your passport, your nephew’s birth certificate, your sister's death certificate, and proof of your legal authority (such as the power of attorney from your nephew's father).

I recommend consultation to guide you through the process, ensuring that all requirements are met in accordance with the current regulations.

Should you need further assistance, please don’t hesitate to contact me.

Best regards,

Hello,

You should ensure that you have the necessary documentation, including the Power of Attorney that was given to you by your brother-in-law, as well as your nephew's birth certificate (showing your relationship), and the death certificate of your sister.

Since you’ve been named as the legal heir, you will need to provide proof of this as well. Visit the General Directorate of Residency and Foreigners Affairs (GDRFA) or the relevant free zone authority where you reside to inquire about transferring your nephew's visa under your sponsorship.

Typically, for a child under the age of 18, a guardian can apply for their visa, and since you are his legal guardian, you can sponsor him as your dependent.

Dear Sir/Madam,

In order to proceed, you will need to visit the Immigration Office located near Dubai Festival City to submit a special request.

Please ensure you bring the following documents:

- Proof of your sister’s death (such as a death certificate); and

- A valid Power of Attorney.

Submit these documents along with your request to the immigration authorities. The final decision will be at their discretion, and they may either approve or reject the request based on their assessment.

Best regards,

Nada Elmawi

Hello dear,

I hope you are doing well!

I'm very sorry to hear about your sister’s passing. Regarding the visa for her son, since you have Power of Attorney and legal guardianship, you can apply to sponsor his UAE residence visa under certain conditions. You will typically need to:

- Provide the Power of Attorney and Legal Guardianship documents, attested by the UAE embassy and the Ministry of Foreign Affairs.

- Prove your residency and financial capacity to sponsor the child.

- Submit the required documents to GDRFA or the relevant emirate authority for visa processing.

We can help you review your documents, advise on any missing legal requirements, and guide you through the process step by step.
