Q: I have been working in a free zone company in Dubai for 14 months and I did not get my salary for more than 8 months.
Every time I was asking for the salary, the employer tells me that he did not get payment from clients and he is still saying like that.
Now, I sent the resignation letter due to the non-payment of salary, but the employer told me that I cannot resign and I need to finish my 3-year contract otherwise he will deduct the amount from my salary.
I don't want to work for this company and also I have a good offer from another company.
So, do I need to work for the employers? Will I get a ban?

Q: If salary is given delayed by the employers for 3 months and the employee filed for resignation, is the employer capable of giving a ban to the employee?
And is it legal to deduct 45 days from the settlement because the contract was not finished?

Q: My employer is constantly delaying the payment of salary. I don't want to spoil the relationship with him, but I want to know if his actions are legal and if he could pay the parts of salary throughout the whole month.
Salary in our company is paid by cash only. As I don't have a copy of the employment contract, I can't say whether anything is written concerning the terms of salary payment or not.
How can I avoid this and what are my rights?

I am Z. A.
My employer is not paying my salary for 3 months now plus another pending amount, and my contract is expiring on 8th May 2019.
I got an offer letter from another company and I resigned from my job.
My query is if my employer does not cancel me after one month or if he does not pay all my dues, what should I do to get cancelled and get my dues paid without losing the new job offer?

The right action when the employer does not pay the salary on time

Q: Hello Mr. Ahmed,
My wife is working in a private company in Dubai since September 2018. The employer and his partner spent 2 months in prison for some illegal activity.
Employer's clients used to call my wife and ask her to finish the pending jobs (the jobs are not her responsibilities but she finished them when her employer requested that from her through the phone) and 1 month back, the employer came out of prison.
For 6 months, her employer is not transferring salary, he paid 2 months' salary in small amounts. 4 months are pending. Whenever she asks, he does not respond.
When she complained to the ministry of labor (80060), they told her they can solve the salary issue, but if she wants to resign, the employer has the right to ban her for 1 year and she has to pay the employer 45 days salary due to her limited contract.
She doesn't want to work with him because of the reckless behavior and delaying the salary. Please advise us if we can take legal action against him.

Claiming compensation for non-payment of salary for 5 months

Q: Actually, I resigned from work due to non-payment of salary for over 5 months with a proper notice period.
Now the company is not giving a proper answer when the complaint has been registered and instead they are just giving the same excuse as they need more time and will be able to give payments in 4-5 cheques which are not acceptable as I have to go back to my home country.
Actually, I would like to know if I refer the case to court, is it possible for me to claim more as compensation (along with salary, leave salary, EOS benefits) due to delay from the employer and giving false promises to each complaint registered?

Can I resign from a limited contract during probation for non-payment of salaries?

Q: Good afternoon Madam,
I am working in the private sector in Abu Dhabi on a limited-term contract.
I have completed 3 months probation period while only the initial 1st-month salary was paid by the employer.
Then after they started to delay and now 2 months salaries are delayed. So what action should I take as I don't want to continue with this employer?
I also want to cancel my labor card and visa without reaching to him since he has not followed his promise to pay my salary on time.
He is also not paying even the rent amount since I am staying with my family outside. If I get another job in this period, can I work or not?
Please advise.

The consequences of leaving a job due to salary non-payment

Q: Greetings,
I am a civil engineer. I got my first visa stamp in Dubai in April 2022 and my visa expires on April 2024. My employer is not paying me a salary for the past 5 months of my Joining.
I want to quit my job and find a new one. As it is my first engineer visa stamping, will there be any ban imposed on me?
I did not raise any complaint to the labor court. Should I raise a complaint?
Please help me out!

Dear Sir,
My contract is a fulltime employee for a company in the UAE, and my leave entitlement state 10 weeks work and 2 weeks off.
However, due to the COVID-19, I have been unable to take that leave and have accrued two months leave or 61 days with four flight tickets.
My question is, can my company legally cancel those accrued days at the start of the new year or would they have to pay me for those days?

How to guarantee labour rights before signing the cancellation paper 0
Good morning All,
I was terminated by my company in March 2020 for not signing the unpaid leave document given to me. I was terminated on 23rd March 2020.
Once termination letter was signed, ever since then, I have been chasing my ex-company for releasing the final settlement and each time they come up with a different plan.
The last option they gave was to sign an agreement with them for 6 months plan but are not giving me any guarantee cheques and insist that I sign the cancellation papers. I want to simply take my money and leave the UAE.
They have also directed me to their lawyers now who insist that any agreement signed with the company is not required to be notarized by Dubai Courts and the company is not legally bound to give me any cheques as a guarantee.
The company that I worked for is located in Dubai and is a private organisation.

Following up on a labor case after traveling to the home country 0
After working for my employer for nearly two years on an unlimited contract as a COO of a restaurant company, my employer owes me approx 193000, not including notice period.
I have filed a case with the MOHRE. They have tried to contact the employer who has ignored the calls and is also ignoring me.
I know that I will have to escalate the complaint but, based on experience with the way the employer treats past employees and how he ignores suppliers and landlords, it is fair to assume that he will ignore this as well.
I have little options and I have to leave the country as the apartment rent paid by the company expires mid-July. If I leave, can I maintain the complaint, and what is the likelihood of getting the money owed in this scenario when I travel back to the UK?
