Legal actions on a salary delay

My employer is constantly delaying the payment of salary. I don't want to spoil the relationship with him, but I want to know if his actions are legal and if he could pay the parts of salary throughout the whole month.

Salary in our company is paid by cash only. As I don't have a copy of the employment contract, I can't say whether anything is written concerning the terms of salary payment or not.

How can I avoid this and what are my rights?

If he's delayed 15 days, you have to call Labor Ministry to make a secret complaint against your company. They won't say anything about your call.

In addition, you have to get a copy of your contract from Tasheel.

Your relations with the employer in the UAE are regulated by the Federal Law No 8 of 1980 on Labour Relations (the "Labour Laws").

As provided therein, workers employed on yearly or monthly wage basis shall be paid at least once a month; all other workers shall be paid at least once every two weeks.

So, unless there is a deficiency in these payments, your employer doesn’t violate this Law.

Keep in mind that in accordance with Article 121, if your employer fails to pay your salary (i.e. your employer violates the payment term stipulated in the employment contract), you are allowed to leave your work without notice.

Simultaneously, you need to file a complaint against your employer at the Ministry of Labour stating the non-payment of salary.

Still, it is really important to know the terms of your employment contract to find a proper solution to your problem. Luckily, via the UAE Ministry of Labour website, you are able to download and print your work contract.

Please bear in mind that if you are working for a Freezone, you can get your employment contract from your respective Freezone company or Freezone Headquarters.
