I have been associated with the company for the past 4 years, and finally resigned as the company was not paying me since March 2020. I have finally got my visa cancelled as I had got a new job offer from another company. The reason which the company gave me is that I was working for one of the group companies, which was mapped as my cost centre by the company. My Offer Letter, Clearance Letter is from the mother company- as they were the one who issued me an offer 4 years back and gave me the visa of the affiliate. I have my pending dues/EOSB with the company and have to start the legal process, as they have not paid me. So, I need to put a legal case of mental/moral harassment which my family has gone through because of all this and get my money back from the company.

Q: I resigned from my job at a company in Aug. 2018 and completed my one month notice period, then joined a new company in November 2018. The reason for the resignation was that the company didn't pay the last 4 months' salaries. The company promised me that time they will pay my settlement and pending salaries later. They gave me only a total settlement paper mentioning my pending salaries and the final end of service settlement. Then I sent the company daily emails to clear my settlement and they only gave me AED 10,000 in January 2019. There's still a balance of AED 38,697 now. Can I file a complaint in the labour department against my company? Please advise if there's any other easy solution. Thank you.

Q: Hello all, I was working under an unlimited contact on an LLC company for about a year in Abu Dhabi. Since I started working, I haven’t got paid on time. So after a year, I resigned from the company by emergency resignation whilst I had 2 months' pending salaries. Now it’s been 49 days since I submitted my resignation and my company is delaying my payments, though my work permit has already been cancelled by them. So can anyone give some advice to take further actions? I’m currently staying on my notice period, so is it ok to file a case against them? Will it take longer?

The UAE has adopted a major reform in its legislative system that brought about 40 new laws and amendments to the company law, criminal law, personal status, among others. The amendments aim to develop the legislative structure in various sectors, the labor law being one of these, was the most recent. We try in this article to shed light on the changes introduced with the new labor law and their significance on both, the employer and employee.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

This Decree sets the rules and conditions for the termination of fixed-term (limited) or unlimited (not term-bound) employment contract between employer and worker in the United Arab Emirates.

By this Decree Ministry of Labour of the UAE has removed the six-month labour ban for those who changed the job before completing two years of service. Labour ban will be still applicable for workers that qualify for skill level 4 and 5 under various circumstances.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
